  • Only getting round to this now?!
They will be able to read the messages on the phone, even ones that arnt relevant. You never truly delete anything of a phone or iPhone. All you are effectively doing is tagging the space as available to be written on again. The data all still there, its just flagged as useable. So unless that space is used now they can pull the data. In some cases even if it has been used they can still find it! Its basally the same as PC's.
Its quite tricky to do tho, that might be why its taking so long. Its very specialist so not just any cop can do it.
The only way that they cant get the info is if the iPhone was jail broken. The exploit used by most jail breaks change the way a phone handles data for use and reuse. So if your iphone was jailbroken they'd need to go the network route. Dont let them try to spin you bs about jailbreaking being illegal or anything because it was de crimmalised, they might try this to remove the jailbreak. I ve designed a bit of on jailbreak code so i know! And now you know that im a total nerd!
Laugh at your problems, everybody else does. The last thing I want to do is hurt you. But it's still on the list.

    • My iphone wasnt jailbroken. But thanks for the insight anyway. Seems bit like they have really taken their time over it but guess my phone is in my favour really,as solicitor said "not consistent with the alleged offence" i really hope it just ties together the fact ive been open and honest the whole way.

I honestly believe that if a person is found to have lied and made false allegations, hey should be made to do the average jail time.

Sending her that book would defiantly be seen as a threat. Would look like you were threating to rape her.

No there is not always a chance of getting murdered inside. It's rare.

            • Ive done several tours of afghan with plenty of attempts to kill me and the men around me so even if someone did try that i would just 'chalk up' another one. But still i would really rather not think like that im really preying that this gets NFAd im sure there should be a lot of evidence in my favour and very little in hers, as all my friends keep telling me but still is having a major impact on nearly all my time i really hate this situation im having a low moment right now.

You really are blessed to have people standing by you. I had no-one and the stress and pain of facing everything alone damn nearly killed me. Take comfort in the support you have and use their strength. Try to focus on good things and not the negative (far easier said than done, i know).

You can and will get through the other side of this.

                      • Ive been thinking about getting references from people that already know about the situation and said that they support me wholeheartedly one is a female army officer, another who has an MBE and another in the police all who know me well and said they would be more than wiling to do a reference or stand in the dock for me. But my question is what sort ofthings should they say in the references? I.e. Subject headings and such? Thankyou

                          • References: Could be along the lines of:

My name is Mr/Mrs/Miss/Ms Bloggs and I write in support of Mr Billy Kickass.

I am a married man/woman and have been married to X years (the longer the better as it shows stability and therefore reliability)

I work as .............. and have done so for X years (the longer the better as it shows stability and therefore reliability)

I have known Mr Kikcass for X years (The longer the referee has known you, the better)

I have known Mr Kickass in the context of employment/socially - whatever.

They can say how you are with women

If they have known you in long term relationships then they can say that

Finish with "I am willing to give evidence on behalf of Mr Kickass if necessary".

All contact details of the witness should be on the statement.

It would help if an ex-partner of yours who you do not get on with will give evidence for you as to your attitude towards women.

If the ex doesn't like you yet is willing to give evidence on your behalf then that would be a good jury point.

You do not present these references to the police otherwise a corrupt officer might take it upon himself/herself to go round to the potential witnesses and mess it up for you.

Gather these statements only IF or AFTER you have been charged. It is pointless doing it beforehand.

                              • It's always a good jury point if somebody who you parted on bad terms with or you do not get on with, actually takes the trouble to come and give evidence for you.

She would be helpful as she would know whether you were insistent on having your way when she wasn't in the mood, or if you accepted the word "no" as meaning "no", as opposed to "she's playing hard to get" which sadly some men still believe.
