      Too Scared To Call

I was interviewed in September of last year and I've still not got my phone back nor heard anything further. I'm too scared to even contact OIC or my solicitor too ask for a update/ for my phone.

I can't deal with this much more daily waking up thinking of this nightmare.. soon as i wake up it's there aswell as i shut my sleep to go to sleep... why can't this be over..

I'm not entirely sure, but my understanding is that not necessarily and that you can apply for a check for yourself to be sure. If you weren't arrested and not charged, it's unlikely, but even then if it does appear, you can apply for it to be removed. Hopefully someone with more accurate knowledge will come in and confirm (or deny!) what I've said.

Frantic is right as usual but my understanding is slightly different, I don't think it matters whether you are arrested or invited for a VI. It matters more if you are charged and acquitted as if there is enough evidence to charge, the allegation will be seen as more substantial than an NFA but neither a NFA or NG is a legal proof of innocence.

As I recall, non conviction information is disclosed in less than 1% of cases and these should only be where the EDBS is needed for work with children or vulnerable adults.

It is the decision of the chief constable whether to disclose or not and as FWW says, this can be challenged. Many legal firms specialise in this.

I believe you should receive some advance warning if anything is to be disclosed but many have advised to apply for your own. PAFAA's legal advisor used to recommend joining the inexpensive dbs update service on the internet but I'm not sure he still does.

Others have recommended applying for some voluntary work that requires an EDBS and I believe you may be able to make a subject access request under the data protection act. The DBS may be helpful with further information.

ANyway, hopefully it will all be fine.

                      I know what it's like!

Since i was questioned at the police station I've not eaten properly, can't sleep, im worried about my family, my 2yr old son...losing him from my life! Friends, and employment!

Social services will be involved according to the police. so i have to tell my son's mother. Which, i hope she does believe me to be innocent.

I'm Really suicidal! My solicitor said could be months or years before charged or appearance in court! and I'm like this after 5days.

How can i find the strength to get through even though my name will be dragged through the mud when my name is Hopefully cleared!

Help and advice is really appreciated right now!
Whilst I haven't been contacted by the police which must be terrifying, I certainly know what it's like after having fun and not even thinking too much about what's going on for people who have found out about some encounters I've had tto then accuse me of being a rapist or sex offender!
Whilst I have not been convicted I certainly have felt being accused of that alone has been an emotional sentence I'm still trying to shake off. I hope the process goes well and your name is cleared as you deserve true justice as you are innocent!
