Now she wants money

Thanks for the support and links everyone. We hope to get an appt today or tomorrow with the solicitor. No money was mentioned in the letter as it was, as you say,a preliminary letter saying she wanted redress for the years of mental problems caused by mr weary. He has so much evidence to the contrary it would be ludicrous to go to court. but it is very worrying when they say things like - send us a list of all your assets - don't move any money- etc etc. As if they are expecting to take it all imminently

These firms are nothing but money-grabbing bullies - as much abusing bullies as the FA’s are. I’m so sorry that you and Mr Weary are having to deal with this.

As CH says, they are just fishing and hoping that you'll settle out of court, much like the parking bullies do.

Civil claims are always possible but the defendant would have to be wealthy enough to make it worth their while pursuing on a no win no fee basis.

As always, each case is different and you may well have good evidence in your favour but the trouble is that a civil court has a lower burden of proof, ie the balance of probabilities rather than beyond a reasonable doubt - or does a judge think it is more likely than not rather than is a jury completely sure.

In other words, evidence not considered strong enough to convict in the crown court can be used to convict in a lower one.

Everything will be crossed here for some positive news.
