    Yep - previous sexual history, in this case she had sex with another person and then cried rape before. I do hope the judge allows this Section 41, not just for your sake, but your case can be used in similar cases to come, where there's been no "proof" it was a false allegation but was merely NFAd (I'm assuming that is the case. If you don't know, would you find out please?)

    Whereabouts roughly is the trial? I'll set aside some time for some "positive mindfulness" today and until the end of the trial.

    In regards to the section 41 I really do hope so I think this holds the key to why she's done the same before and why she's done this to me the previous allegation is still ongoing as the alleged suspect can't be found ?!? She's also said in her statements that she has a history of depression as well as being abused by her step father as a kid and then went on to work as a escourt ! So I do think this has a massive bearing on my case ?!

    My trial starts on the 10th Feb in Devon and is set to last for 3 days

    • Working as an escort is unlikely to have any bearing on the case. Escorts can still say "no" of course. It's the business of making previous allegations that have not been proceeded with that interests me.

      Shame you aren't in Dorset as I might have been able to attend to offer support.

      There was a case posted on here from the media where the complainant had previously made allegations that were all NFAd - the judge allowed that evidence so hopefully your judge will allow that in your case, although it seems it is only one. Fingers crossed.

        I agree she could of said no but it paints a picture of her that she is a street wise girl and not the innocent nieve victim she is making out she is.

        She's accused once before I believe that case is also still ongoing as well .... Even her mum said in one statement that when she went to pick her up at the hospital the next day she said you can't keep doing this?

        RF is it right this application is made on the first day of the trial ?

        Also do you think the CCTV of her walking fine chatting laughing all over me all night will aid my defence ?

        • You are entitled to "correct a false impression" that she has made. If she tells the jury that she is Snow White and is not an escort then that can be put in - mind you there are escorts who don't offer sex and those who do. You would need to prove which one.

            Just had the section 41 sent through to me from my solicitor its is basically saying that it's not to discredit her but merely to present fact based evidence as to her state of mind having made a allegation only 3 months before and she was disappointed that she put herself in that situation again

            Hope it's allowed as I do think this is crucial
