    Woman 'inconsistent' with reports of repeated rape, court told

    Seven defendants aged from 18 to 36 deny a string of sexual offences against a 21-year-old woman

    A woman who says she was repeatedly raped by seven men at her own flat last year has been questioned in court over "inconsistencies" with her accounts of what happened.

    The 21-year-old was quizzed at Guildford Crown Court on Thursday (October 22) about the alleged sexual abuse, which was said to have happened over the course of several days.

    The jury had previously heard from a police interview with the woman how defendants James Wilson, Charlie Jones and Shane Eastwood entered her flat on Thursday October 23 last year and forced her to perform a string of sex acts.

    The alleged victim said Charlie Jones told her to perform a sex act on him and then "offered" her to other people.

    "He instigated it the first time and [James] Wilson said no," she said.

    “Charlie raised his voice and asked again and the second time [James] Wilson agreed.

    “For some reason I just did it, I felt dirty.”

    The court also heard how the woman was made to perform a sex act on Shane Eastwood.


    'Involved in a sexual act'

    But defence barrister Rachel Darby, representing 36-year-old Mr Wilson, questioned the woman's version of events saying there were “inconsistencies” with the accounts she had given in previous interviews and that she was "very confused".

    The woman replied: “I know what happened but I can't remember what times and days it happened.”
    Ms Darby then went on to say: “In your police interviews you say you performed a sexual act on James Wilson in the day and now you are describing the event happening at night.

    “I'm going to suggest the first time James Wilson came to your house was at 5pm on Thursday 23 October and that he arrived with Shane Eastwood.

    “Charlie Jones and around three other males were already present at the time he arrived.”
    The woman replied: “No, I don't remember.”

    Ms Darby continued: “Once at the address, you performed a sexual act on Charlie Jones.

    “You in fact asked Wilson on one occasion if he wanted you to perform a sexual act on him, to which he said no.

    “At no time did you perform a sex act on James Wilson and this was the only day he was at your address.”

    The woman told the court James Wilson went to her address twice, once on the Thursday and then again on Sunday October 26, but she could not remember what time.


    Previous allegations

    Ms Darby also informed the jury that the woman had made a number of allegations against males in the past.

    She said: “When you were 16-years-old you made a sexual assault allegation against a co-pupil.”

    The court heard the student was arrested but police took no further action.

    Ms Darby also said the alleged victim made another allegation of sexual assault in March 2009, saying an ex-cadet leader had touched her leg and bra strap.

    The man was also arrested and interviewed but no further action was taken.

    And in November 2008, she made a sexual assault allegation against her step-grandfather, claiming he fondled her breasts and touched the elastic of her knickers.

    On that occasion, police arrested the man but later dropped charges.

    I find this story interesting as previous unfounded (but not proven lies) allegations made by the complainant were put to the jury. In my experience, usually only allegations that were proved false (ie via NG verdicts or confessed) went before the jury. NFAs usually mean that there is insufficient evidence to prosecute. Obviously some innocent people are NFA’d but so are some guilty.
