Husband accused of rape

  • Thanks CH. Do you think SHE has suddenly changed her story to "attempted" rape, or whether there is no evidence of rape, so the CPS have thrown this in as a last resort? From what my husband has said, after he was interviewed, ( he refused to change anything from his original statement, she read it out to him, he just kept saying-that is correct) the dc rang the cps and they said "charge him with attempted rape". Well, surely they knew what they were going to do before his interview, they couldnt have made their minds up, just like that surely? Cannot wait to see her statements. I KNOW she has accused him of rape. She has told everybody. Her husband went next door to my sister in law the next day and told her. Thats what we were told by police, that she had accused him of rape. Nothing is found except this "cellular" dna, and now it is attempted rape, which hasnt been mentioned before. He either did or he didnt! Soo confused!

      i am sorry to hear about the results and my results are not good as well, i just re-bailed for 3 months, they checking my phone.

      but in your case the positive thing is, he is not charged with rape. I don't understand why CPS is taking this so far because no biological evidence (semon) found. the base of these cases is to have proper evidence's which cps don't have it. so i am sure and i will pray that you will win your case.

      the women won't get away with this big lie. she will face something alot bigger then what she gave you.

        You mentioned yesterday that your husband was to be re-interviewed and wondered why. I didn't want to unduly depress you at the time but one of the reasons for this is that the accuser has made some fresh allegations which they want to put to the accused.

        So yes, almost certainly the police have told the woman that there is no DNA evidence to back up her allegations and rather than admit that she had made the story up and risk being charged herself with PCJ, she has come up with this new tale which conveniently doesn't require actual proof!

        Of course somewhere there will be a written or videoed statement of the original rape allegation and it is vital that your solicitor ferrets this out. It will be difficult for the woman to come up with a convincing explanation as to her subsequent confusion between attempted and actual rape.

This makes sense.She makes all these allegations, husband leaves her, she finds herself trapped between me and my brother, on her own, she says she wants to drop "charges", then she is told "no, otherwise you will be charged with pcj," finds out there is no dna evidence to support her claim, then is obviously "persuaded" to alter her allegation. We too, also hope the sol has kept evidence of her previous allegations. But what if my husband decides to get a different solicitor, will the present duty sol then, maybe, "lose" all this info,or can we still obtain it from somewhere else? Like I say, I trust no one at the mo, after all, it was his secretary that told us, it would just be a "short" interview! Like someone else said in a previous post, everyone is making money out of this - except the FA - we are losing everything!

            When I read your post yesterday (or the day before because it is 1am). I had the feeling that it would only be an interview.
            CH is more experienced than I am and he is right about this woman and the PCJ.

            If your husband changes his solicitor,he will still be able to receive all the documents about his case and fight for his defence.

            • Thanks BDC, we were told "only a short interview", how the hell can they get away with these outright lies! I sat there for about 2 hours waiting for my husband to come back from his "short interview", when I was approached by this DC`s side kick who told me that my husband would be "a while", didnt know how long, but to disappear into the city and he would phone me when my husband was finished, maybe a couple of hours. Well, I went shopping around a city that I dont really know very well for 3 hours,then went back to station as it was getting dark, I was soaked, overloaded with shopping and asked if he was still there. Was told yes, didnt know how long he would be, I was told to go back up to the city for a "couple of hours". Said - I have already done that! Cant carry anymore, Im soaked and its getting dark,have no where to go,and they begrudgingly let me stop there and wait for another hour or so. It was only because we were told "short interview" that I went, to do Xmas shopping. Nobody would tell me anything. I had all the family ringing and texting me towards the end, because they were so worried about us, because they expected us to be home, and I could tell them nothing. Love my family, they will be behind us all the way, no matter what, more than SHE can say

                      Hi! Could anybody please recommend a Specialist solicitor in the Worcestershire area (that works on legal aid)? Is it correct that if you pay privately for a solicitor, you do not get any money back if you win your case? Also, how much money are we talking about for a private sol for this type of case (approximately)? Thousands?

                      • Sorry you find yourself in this position but it does not shock me, I too was arrested,bailed on several occation and charged with Rape. A week before my trail the CPS announced they would not be presenting any evidence against me so at court the judge declaired my not only Not Guilty but inocent. The police and CPS are not interested in the truth only in getting convictions so please please please get everything you can,no matter how insignificant it may be and give it to your solicitor. Once in court I found the Judges to be decent and well aware that the CPS are clutching at straws so there is hope in the system.

                        To answer your question and I'm sure someone will confirm/correct me but in my case I paid for both solictor and barrister and all costs including trail came to 35-40 thousand and I am in the process of claimimg that back, however I believe that since October you can only claim back the cost equivilant to the lagal aid cost(no idea how much this is). If your husbands arrest was proir to a certain date thay may allow full costs back so well worth finding this out. I am not a wealthy man and had to sell everything I own including my home to get these funds but it was worth every penny to me, she walks away with 11k in compensation and is booking a holiday and in my mid 50's I have to start to rebuild my life....what a system.

                        • Hi Barney, thanks so much for taking the trouble to answer my questions.I was so pleased for you when you were found not guilty and really hope you are feeling better now, and are at least, starting to re build your life. Her £11,000 will soon be spent and what will she be left with? Maybe, one day, a guilty conscience, that with her lies,she tried to put an innocent man in prison. You, though, have your friends and family behind you and the knowledge that in the end, even the law was on your side.
                          I agree, this justice system is appalling! She is believed from the word go and the man is treated as guilty from the start. My husband was locked up in the cells for hours on Friday, because he wouldnt change his statement and say he had raped her, even though all the forensic evidence said he never. At one point, he told them to suspend the interview because they were being so nasty to him. You can bet she has never had this kind of treatment, trying to get the truth out of her! Well, she will in court! A lot of opinion amongst people we know, is that she will try to get out of it, by taking an overdose the day before etc. But its too late for her now. She has made her bed, she must lie on it. Take care, Barney
