      Thanks RF,

      myself & Mrs CH have been having spirited 'discussions' about this subject (she coming down in the adult@16 camp) and our sticking point was the 'what if two 17 year-olds get married or cohabit', and you have answered that very well.

      As you say it's a mine field; lets assume that a 17 year old travels to Asia and meets someone just over 16. They have a super holiday romance but our traveler picks up all the wining & dining tabs & buys a bit of jewelry as a leaving present. To spice up the scenario there are some 'interesting' pictures from the liaison on our traveler's camera; so would plod be waiting at Heathrow?

      I've really don't know the answer, except that if our traveler happened to be an American citizen they would certainly be in trouble!

        Okay, so if I've read this right, in summary the SOA would be used for sexual offences against a person, for which Under16 would apply, and for images then the PoCA 1978 would be used as it would utilise Under18.

        My own case isn't really relevant as a) I was much older than 18 and b) it didn't happen anyway. I was considering more of say a 22-year old having sex with a 17-year old. That was the scenario I was thinking about when I said if the female is over 16 but under 18 would it necessarily mean the 22-year old would be safe?

        God, that's waaaay too much thinking for midweek.

          In that case being the very norty girl I was when I finally escaped from my adoptive parents at 17 years I could easily make £K's on the back of my bad behaviour! One boyfriend was 34!

          I don't think it makes any diff to be honest if the relationship is consensual between a 22 year old and a 17 year old. It's their private business.

          If she decided to cry rape (or indeed, if he really did rape her in this hypothetical situation) then she would still be treated as a "woman over the age of 16 years". The court would take a dim view if he was much older.

          One of my group members aged 50 is engaged to a young lady of 18 years. She was 16 - it made the tabloids - when they got together. They are to marry later this year.

          Due to what he was falsely accused of I am sure that "the law" would have stepped in quick smart if he had "broken the law"by getting involved with this incredibly mature young adult.

          I've seen them together and they are absolutely brilliant. I wouldn't normally condone such a match (because of my work and what I have seen during the course of it) but they are so right together.

          That's a different subject though. The point I am making is that if this was illegal the police would have made soemthing of it when he was falsely accused of something by another person.

            Sorry, the 50 bit/age gap just reminded me of some moons ago when I was 29 I was friendz with a 49 year old lady who wanted a bit more. Nice enough person but not my type.
            I never forget when she swooned one time and said she only felt 29 years old when she was around me, to which I replied Well, you're not feeling this 29 year old!

              I'll probably stick with that one for now. I'm flying that exact helicopter in a flight sim at the mo, and never realised they were so much hard work. The real thing's easier.

              Also, I'm finding many good avatars out there are just too big for us. For an avatar to work here it's got to be so tiny in dimensions and less than 19.5kb that I'm limited to what I can upload.

                      I hate to say it, but there's nothing you can do to make it smaller, as it's a GIF file. A GIF is the computer version of the old flip-pad animation we used to do as kids; it's a series of drawings which play in sequence. Had it been a JPEG file you could resize it, but not really possible with a GIF.

                      Only reason I mentioned its figures are if you wanted to put it in another forum you'd know in advance if it was likely to fit before wasting time.

                              just to add another bit to the 16/18 debate. i was raped at 16 and he was charged with rape of a female over 16, not a minor. a 17 year old can not be detained under the children's act and must be detained under the mental health act yet they can be held on a children's ward (often only if they were in education just before becoming ill). interestingly child protection in the nhs means they can't inform police if a victim of abuse or rape is over 16 (unless they believe the person is still at risk) and they can't inform parents without the victim's permission. the police, however can inform parents of people age 16-17. if the police and nhs can't even make up their minds then no wonder people are confused.

                              the cica compensation for rape is the same for both under 18s and over 18s. the only difference is there are a few extra things which a child can be compensated for (touching over clothes i think may be one of them). also it clearly states that a child can't claim if they consented but were deemed in law to be unable to. i.e. a 15 year old can't claim if they slept with their 16 year old boyfriend because they would not have been scared for their life etc and feeling in danger is a key part of the cica claim. if a child under 13 claims i think they automatically can even if they didn't feel "scared" because they are always considered a child and it is assumed they played no role in instigating it.

                                In (alleged) historic abuse cases the complainant can be awarded "compensation" if the"abuse" started (allegedly) from an early age and went on for years. The more alleged assailants the more money.
