  • Changing legal aid solicitor

    Signed up for my current legal aid solicitor while in police custody.Hadn't got a clue who to use,or that I could benefit from experienced solicitors.
    No trial date set,but have been to court 3 times with current guys.
    They've not been very impressive,and have refused to follow my instructions about appealing my bail conditions.
    I tried to change,but they've objected.So in anger I wrote and sacked them.Have also appealed the judge at Warwick to transfer.Was told he'd probally not let me change,so sacked my current lot,and told the judge in writing i'd rather represent myself than use the current lot,as they had completely lost my confidence.Waiting for word of both this,and my trial dates.

    Oh well,you lot seem intelligent folks,what do you think?

    Not sure about the intelligent bit! But RF will be along shortly to advise you.

      There may well be good reasons why they did not challenge the bail conditions. Why do you want them changed as often they also protect you from contact with complainant(s).

      You have posted the query up on another thread relating to a transfer of funding and I have answered it. Try to keep questions that relate to the same subject in one place.

      It is unlikely that the judge will allow you a transfer of funding. It's not like "the old days" where one could do that willy nilly.

        I have strong views about our Judicial and besides a handfull would strongly suggest you seriously consider your options carefully before trial - your defence council IS absolutely vital !! there is no other way to put it.

        Under Illegal Aid too many have been left to hang and allowed crown council to walk all over them leading to wrongful convictions, the system isnt usually interested in the truth and justice - only convictions oh and bonuses ofcourse.

        If your hands are tied with Legal Aid I would advise you to consider what other options are available.

        By the way you didnt state your plea on any of the allegations so we can only assume? !!!!?

          Legal Aid is now known as "Public Funding" and the amount a defence team can claim has decreased in the last 18 months or so.

          Transfers of funding are rarely allowed and using a medical condition is not going to help. LSC is not interested in a defendant's health. You also need to remember that many publicly funded trials result in the correct verdict for the innocent and of course some guilty defendants "get off scot free".

            Thanks for the comment Rights Fighter,and while some trials result in the correct verdicts many do not.
            Having a specialist is vital in these cases where it boils down to the words of two people.
            I won't accept second best where a life sentence can be given because the jury likes the look of one more than the other.
            I have had some dealings with united against injustice,and Max Szura recommends using a specialist firm,and sacking incompetent ones.

            There are european laws on fair trials etc,if you have any ideas of what they are etc,and could they be used to argue about a fair trial then that would be useful info.I do know a judge has it in his power to change,but he'll need to be pressured to do so.What I really need is to make it look like I mean business.I do tend to find that in general people will give in to the akward ones,but will not to the easy ones.I just need the ammo.

              As far as I am aware nobody on this forum knows anything about your case so we cannot help you to prepare your ammo.

              Unless you have thousands of pounds to spend privately on the case then you may well be left with "second best" if the court does not allow a transfer of funding.

              Good luck with sacking your current solicitors and the court allowing your to transfer your funding.

              PS: If you are getting advice (that you appear to be listening to) from UAI then why are you here? Would your questions not be better directed to the group you are already taking advice from?
