  • Advice pls!

    I can not go into to many details - but the mother of my baby who accused me of organising her rape a year ago - the whole thing has moved into the civil courts. She has made up quite a few more allegations since then - going from organsing her rape to actually raping her now aswell as hitting her on several occaisons - etc etc. All this is going to a fact finding case later in the year - However now she has back pedalled on quite a few of them effectively admitting she has lied!

    My question is - Can I now get her arrested for wasting police time?
    Or as the police NFA'D it at the very least can I get it changed to no crimed so it will not show up on my record at a future date?

    Only the police can "get her arrested" for wasting police time. You cannot do that although you could contact the CPS and ask them what they intend to do about the wasting of police time and perverting the course of justice by lying.

    The allegations will lie on file and could show up on CRB checks. You will need to see a solicitor to see how to go about getting that removed - not always possible though so don't hold your breath!

      i was told by the police that no file or anything else would be on my record,after they and the cps dropped the false allagations about me, are they lying?

        It is entirely possible that the person who told you that doesn not know the answer to the question.

        Common sense would suggest that this would not appear on your record but then common sense never did have a place in the British Judicial System.

            i doubt the police would arrest her because it is expensive and the cps probably wouldnt want to fund it cos lying, although extrememly distressing for the accused, doesnt make her a liability to the public in their minds. but its not just people who are falsely accused that dont get justice. the man who raped me told a number of lies that i could prove werent true and as far as i'm concerned, completely jeopodised the case. he claimed i had come to where he worked for months after it happened and that i kept changing my appearance. despite the fact i can prove its lies because i was detained in hospital BECAUSE of what happened the cps wouldnt take it forward. i obviously couldnt leave the hospital, let alone keep changing my appearance to stalk him!
