  • Toxicology Report HELP

    Hi been told my case is pending the outcome of toxicology reports. Does that mean the current evidence they have is not enough to charge or is it due process to wait until they get the toxicology.

    I have admitted to consensual sex and told them to obtain cctv of us kissing and touching whilst out which they now have. She claims to have been drugged but no memory of the drinking whilst out or the sex.

    Has anyone gone through having to wait for toxicology results?

    Hi NG 1000,

    I would say that it simply means they haven't finished their investigation yet.

    If there is CCTV that shows her drinking and the kissing etc then it will go in your favour.

      Thank you for the response. So just to clarify, waiting for toxicology is routine. If they had a strong case without the report would they not have charged me by now? Or are they hoping the report will strengthen their case?

        I’ve been a visitor to daft moo for over 4 years now and I can’t say I recall a charging decision that didn’t take at least a couple of weeks but more usually several months.

        Toxicology might strengthen the accusers case but as SB said on the other thread, she may have taken drugs voluntarily, likewise, while it is a myth that rape always causes some visible internal injury, such injuries when present can also be caused by consensual activity ( rough sex)

        It’s very rare for there to be clear evidence of a rape where it is a question of consent and “enough evidence “ is specific to each case.

        The toxicology tests may be the final piece of the jigsaw Before a decision is made but I would advise you to be prepared for a longer wait yet.
