  • What happens to your record if you don't talk to the police?

    My FA falsely reported me but refused to make a formal complaint; therefore I was not required to attend an interview but was asked to attend a voluntary one. On the advice of a lawyer, I refused and the public prosecution service wrote to me to say they would "not prosecute."


    I understand that only the enhanced criminal check will show an NFA but how about in my case? Will it appear at all and how will it be treated?

    The statistical likelihood is that nothing will be disclosed, even on an eDBS but the thing is that to be sure, an eDBS has to be applied for.

    It may very much depend on the nature of your current work whether public protection measures come into play.

    You may find it helpful to ask for a subject access request ( SAR ) under the data protection act

    Joining the DBS online update service may also give you early warning

    Applying for some voluntary work that requires an eDBS could also give you peace of mind.

    The decision to disclose is entirely the responsibility of the chief constable as far as I am aware and this decision can be challenged, first through the local complaints policy all the way up to a judicial review if you have reason to
