  • Help with an appeal please!

    Hello, I am new to this today so please bare with me. My brother is in prison wrongly accused of attempted rape and sexual offences to his ex step daughter. Please does anyone know the procedure for appeal as this is just horrendous and we are a loving caring family and don't know where to start to look for help. And advice is much appreciated x

    What does trial counsel say about the prospects of appealing the conviction? Your brother is entitled to a document called an "Advice on Appeal", which should outline the basics of the case and the trial, and why there are grounds (or not grounds) for appeal.

      Hi apparently there is no grounds for appeal but we cannot understand this as lots of things were not brought up in court so we need to know what to do now.

        The things you wanted brought up, did they go directly to the heart of the allegations? In other words, would the jury have come to a different verdict if they had heard the evidence?

        it is almost impossible to persuade the CA to accept evidence that was available prior to trial.

        What were the reason counsel / solicitor gave for not using the evidence?

          You will need something quite compelling to get it past a single judge for appeal, if your counsel has said no grounds.

          might be better to actually speak to a specialist solicitor from the thread on this forum, as it can get quite involved and technical.

            To get legal aid you would need to show you have grounds to appeal before a sol can apply for LA. How you are supposed to do that as a lay person I really do not know.
