    Can I ask, are these new guidelines for the cps bringing cases forward for prosecution just guidelines, or have they been translated into law as well?
    P.S. Following on from the last post, obviously things may not come to this point (let's hope not), but a friend of mine has said that it may be a good idea to start preparing for the worst. I think this might be a good idea as he has told me that if the cps do take matters further then they will aim for the earliest possible trial date; his worry is that if things continue as they are then my solicitor will have no case prepared and supporting information may not be gathered in time for the trial date.

      it is a good idea to start preparing as in starting a journal and write in it every time you think of something that could assist - if possibly do it in chronological order - you'll be surprised how quickly the jig saw is put together. Also talk with people who knew you back and then possibly the complainant.

      Would you be eligible for legal aid or are you able to pay privately? There are some fabulous legal aid sols and barristers - and some not so good. Paying privately allows the sol and barrister to spend a heck of a lot more time on the case. Legal Aid now only pays by the case, and not by the hour.

      I know of an utterly legal aid barrister who would cover your area. Obviously he can be instructed privately too. Any more info please PM me. In fact I'll PM you my email address

        Hi RF, not answering directly here as I have your email address. This is just general info to anyone reading. Big mistake yesterday apparently my phone provider can only pass info from MY phone not incoming texts.
        Spoke to a forensic company today. As I only have a throw-away cheapy phone, to my horror, they said there's only a 65% chance of retrieving the deleted texts from my phone. They did tell me if things do take a turn for the worst, my solicitor can request my accusers phone for forensic examination as well as my own.
        Now I intend this as encouragement, but bear in mind its only the forensic company's opinion. He told me that my phone won't be in a back log as I have been told, he said they won't have sent it off. He said if they haven't bothered to send the phone off yet (after 7 weeks) he said it means they probably aren't taking the accusation very seriously. I'd like to believe this obviously for myself and anyone else who is undergoing the torment of a lengthy wait and I would appeal to all the members of the judiciary system who are reading this: could there be a way of letting the accused know the progress being made in cases like this? Despite what you say publicly, you all know that as the number of rape accusations rises, inevitably the number of false accusations will rise not just for myself, but a significant proportion of cases reported. We, the falsely accused are experiencing only a fraction of the trauma that a rape victim will face; but we are experiencing a significant amount. I appeal to you as human beings, if you can, please bear this in mind.

          Please don't bother with people who have no idea who these things work. There IS a huge backlog in these cases where phones and computers are in a queue waiting to be examined, depending on the area.

          Ask the OIC if the phone has been sent off and ask if they know if/when it will be returned back to the police station.

            Hi RF, no idea, as he works for forensics I'm guessing he knew what was what. As I've said it's just his opinion. Obviously you're more of an authority in these matters, I'm happy to go along with whatever you say. Didn't realise I could ask this.               Unless he's in contact with your OIC how on earth would he know that the phone has not been sent off or is being examined within the police station? How does he know there is no backlog when we read in the media that there is! It's bonkers!! Sheesh!!

                    Possibly but even then how would he know what's going on (or not going on ) in your local plod shop?!!

                    If he was trying to be kind then that's a dangerous way of doing it. Some people might believe him and he could be wrong. Guesswork doesn't help.

                    Who knows what is going on in the police station or whether they've had to send it out to forensics or whether they undertake such examinations in the police station?! He doesn't as he's not there.

                      Don't know whether this will be of encouragement or not (regarding your phone being examined or not) but after I got my NFA the OIC told me that they weren't going to carry out any DNA testing (on cost grounds) unless I was charged! (yes, this does take some getting one's head around...)

                              To be fair to them, the DNA forensics would have related to a 'count B' accusation and there was already doubt about 'count A' so the OIC probably realised there wouldn't be any.

                                Sorry CH, count B? count A? And how long ago was this? Have procedures changed? I ask obviously on behalf of myself but of course this may help others too.
