    Hi guys,
    My fiance ,,S,,(36yo) has been arrested on suspicion of rape on Wednesday at 4 in the morning, interviewed for 4 hours and sent home on bail in the evening.
    The story is like this:
    In march he met this girl ,,H,,(19yo) at the uni and become aware of each other. They had dinner where they concluded that they feel attracted to each other. They slowly started to exchange flirty mails and txts ,,H,, arranged for ,,S,, to go around to practice some techniques from uni while her 15 yo brother was home and ,,S,, ended up giving her a erotic massage (he is a massage therapist) but no intercourse and no oral .The txs and emails after that become very sexual like for ex: she was fantasizing about rape scenarios and double penetration even fisting! etc…another date was arranged at her place where she lives with her parents. They plan one of her rape fantasies where ,,S,, come in and kiss her and she will say no no but he will carry on etc…(Why she will get excited about rape is beyond me as I was raped when I was 13 and I never recovered(I am 35) and I will always be damaged in a way that is hard to explain and never went to the police or even my parents but this is another story)I have this rape planning on email. The day arrived and 15 mim away from her place she txt that her mum is going to be home at dinner time and maybe he should go back but in the end they decided to carry on and inventing a story for her mum as why ,,S,, was there. They had sex, mum and dad came and she became nervous, all of them had a coffee a chat and a laugh 1 1/2h later they left and they had sex twice after that. She said that her mum was not happy with him being there and she is scared of what she may do to her when she will come back home. He txt her several times to ask her if she is ok and if her mum was ok to her… no response.
    ,,H,, said that she has been given consent to foreplay, kissing ,fingering and oral sex performed on her but she said no to the penetration (as they planned in her fantasy) but she agreed to the other two .
    He was really nice in the emails like for ex. she said she likes fisting but he wasn’t comfortable with this or she likes double penetration by two man and he will not comfortable with this either and loads of reassuring from him like: ,,this fantasy is about you and your pleasure,is your game and I want to give you your best fantasy ,, etc etc.
    We think that the mother come home and raised hell and she had to come up with something. She comes from a fairly good family and I don’t think the money is the reason. She even mentioned to him that her mum can see right through her and she will kill her!
    I have most of the emails (lots of them) but the txts have been deleted.
    The police officers were very professional and a solicitor was present and advised ,,S,, to tell them everything that happened and he did.
    He has been given the mobile back at the end of the interview along with everything else and I know this is unusual as they like to keep it as evidence along with the laptop. Is this good or bad? They said that they don’t need the emails for now. Is this good or bad?
    Police said don’t worry as everything will come out in the wash and the solicitor has a good feeling about this. And they also said that is possible to get back to us within 4 weeks to tell us the nfc otherwise they will see him on bail date after 6 weeks.
    What do you think?
    Is no need to say that I am going out of my mind and ,,S,, is suicidal and we experience all the stuff that everybody on this site goes through. I have been reading this site for two weeks now and I feel like I know you all, crying at your stories and clapping at your banana dance.

    Hi and welcome to the forum,

    As you have been looking at the forum you have already realised that your fiancée has a fairly good defence to the accusations in the emails. I'm not sure from your post if the laptop was seized and if this contained the emails but, if it is still possible, it would be best to save the emails on a memory stick and keep them somewhere 'safe'.

    Realistically, I am surmising that the police don't want the emails because they help his case; had they been solely from him to her suggesting these rape 'games', it might well be a different matter!

    Regarding the texts, I am technically challenged where mobiles are concerned, but other members have suggested previously that it may be possible to recover deleted texts either from the phone memory of from the network provider.

    PS. Well done for supporting your fiancée instead of giving him a good slapping for his infidelity, you are a gem and I hope he appreciates this.

      Hi, thank you for your fast post. The rape game was her idea. We have the laptop and the mobile and all correspondence has been put away for safe keeping. I got S to write everything down like you guys are doing and little details are coming to light like her mum made her have counseling after the boyfriend dumped her. Why need counseling at 19 ?
      I researched the recovery of the txt and I found a software that does it so that is on to do list this weekend.
      I am scared we cant afford a specialised solicitor and because of that I am agonising. I mean we are your tipical young couple, no savings, trying to finish uni while woking full time.
      Our solicitor is not the very good
      I just love him and I am doing what any woman should do.
      . And I can't leave him while he is down as I am all he's got.. in spite of what he did is still is a wonderful man.
      And I understand why he did it...
      Anyway any help from you guys is appreciated.
      Ps can somebody move this in help and advice if possible pls.

        Regarding instructing a specialist solicitor, this isn't really necessary unless he is charged; as you are likely to require legal aid they cannot make a claim on your behalf until then so will receive no remuneration for any time spent (though obviously any further interviews that your fiancée may be required to attend will be covered under the legal aid scheme)

        Having said this there is no harm in researching potential firms that are specialists and undertake legal aid work; a good starting point is our sticky:

          I was thinking that if he does get charged he will be represented by this solicitor that is not really specialised for FA . I am trying to make a plan of attack if we get a bad news. No solicitors around Nottinghamon the list... I have been reading hoorror stories about useless soliciors on this site and scared the hell out of me! Not to mention that the belive that justice will be done is shattered... the solicitor said that if he is not getting FA after 4 weeks ia most likely that he will be charged on his next bail vizit.Now this to me sonds like a lot of nonsense as can be a multitude of reasons of why it could be re bailed . Thats why I think she is not that good and she also wanted to hand in the emails to the police
          But I told her that the police doesn't want them yet. Should we send the emails to the police

            The duty solicitor is the next name on the rota and it is pot luck who one gets; one member actually got a specialist in defending FA's and obviously stuck with them. It is accepted in the profession that another solicitor may be chosen to defend the case (after all the accused person may already have had prior dealings with a solicitor and want to use them. After charge it is much more difficult to change and that is why the right choice must be made in the first place.

            Hopefully some members may have personal recommendations for solictors in the Nottingham area for you, but remember he hasn't even been charged yet!

            As regards timing, some members have had a NFA after a few weeks but usually the decision to charge is made either instantly (when there is no doubt) or after a much longer investigative period (several months is not uncommon)

            Regarding the emails, as the police haven't specifically asked for them keep them under wraps for now. If you hand them over it is likely that his accuser will be reinterviewed about the contents and this will give her an opportunity to come up with a convincing explanation.

              Hello Sanaro.

              Sorry to find you here but I wouldn't worry too much as you have already collected some strong evidence (the emails).
              Your boyfriend is being proactive by writing all the details and he must keep on as he might remember more details as time goes by.

              Save the emails on a usb key (print screen and print them as well) but please do not give them to the police.
              As Casehardened rightly said she will change her story.

              Meanwhile you can look around for a specialised solicitor but he would be able to help only in the event S gets charged.

                  Thank you very much for your support!
                  It makes perfect sense now to hang on to the emails ...
                  I know is not charged but I need to actively do stuff otherwise I breakdown and that is not an option now.
                  Any tips in choosing a solicitor?

                    Can't help with a solicitor I'm sorry but just wanted to wish you well. It can be a bumby road but hopefully the emails will help enormously. Listen to me .... unbelievable that I still believe in common sense!

                        Does anybody knows about Bird & Co. Solicitors ?
                        Can you please, please,advise if you know them?
