False accusation of rape

My son was accused of raping his girlfriend in Scotland last year. He claims the accusation is false and the sex was consensual.

The Police arrested my son and kept him in a cell over the weekend. He was told he was charged with rape and would be up in court on the Monday. However when the time came for the court hearing he was released without going through court.

How long does the PF have to bring a case if one is going to be brought?

Any other helpful advice would be appreaciated.

You haven't mentioned whether you believe your son is innocent. What are your thoughts?

Hi Gen,

Usually it's within the year if a case is going to be proceeded with.
Your Son or you could write to them and ask for an update as they won't automatically tell you if a case isn't going to be proceeded with.
