  • Just Accused, need an advise

    How do you like this one.
    My wife had run an affair from end of April to end of May. It eventually became too evident and she confessed. Agreement been reached that she is moving out to build new life and leaving our 5 yo son with me.
    It took her a week and a halve to bet out but during first 5 days she approached me in my room 3 times and it ended with quite passionate and emotionally bitter Sex. After that I tried to stay out of the house and moved to Bedroom full time.
    After a month I gave her forms for generous on my part child settlement but after 2 adjustments she has changed her mind, refused to sign and threatened me with Rape Allegations.
    Now is the Punch Line!
    Yesterday I have been contacted by the Female police DC and asked to come over for questioning as allegations has been filed.

    I would appreciate an advise very much.

    The best advice I can give you is to make sure that you attend the police station with a solicitor...preferably one who is an expert in these matters if you can get one at short notice.

      Hi & welcome to the forum,

      The above is an invitation you cannot refuse, though as you have not yet been arrested it would seem that the police are keeping an open mind at present.

      Nevertheless the consensus of opinion on the forum will doubtless be that you must still take this allegation absolutely seriously even though you feel it is unfounded(possibly your wife has had second thoughts about relinquishing custody of your son and this is her way of achieving her aim)

      It is essential that you consult a solicitor prior to the interview to determine the course of action (for example they may suggest you prepare a statement beforehand) as well as sitting in on the interview. It would be best to instruct a specialist in this field; if you post up your county you may receive recommendations from members, alternatively there is a sticky in the forum of recommended firms.

      PS, if your username is identifiable to yourself I would suggest reposting with an anonymous username & I will delete this thread (only admin can change usernames and they may not see this till much later)

      EDIT.....Sorry my typing was slower than Faith's, but at least it reinforces the message!

            Thank you for the Statement Idea

            Solicitor cost money and as she left she was not exactly empty-handed. Had to get New TV, Sofa etc..
            I run low credit now for another quarter at least, also wanted to take my Boy to Spain (look outside, is that a summer??)
            But, DC asked if I need a solicitor and offered Free one. I agreed and he will be present on Friday. Should I cancel (if I can?) and contact another one?
            For statement Thanks.. will hey accept it before Taped "Interrogation"? and can I mention my point of the possible motives?
            Its money by the way. Last time she was single mother she managed to Grab enough for Nose job and Brest Implants.

            Honestly... In the future I am moving to Dubai or castrating myself (spiritually)

            Sorry for Playful mood, consulted one bottle of Frenchman called Bordeaux. Can not believe tat she want to lock her son Father otherwise...

              Duty Solicitors (the free ones) can be good. Some can be dreadful.
              However, this is a Serious Arrestable Offence (SAO) so it is vital that you trust the legally-qualified person you have at your side.
              Whatever you decide, please do not refuse legal representation. Whoever you choose, talk to them before the "interview" and make a decision from there.

                A prepared statement usually goes hand-in-hand with a no-comment interview, the idea being that the interviewing officer can't inveigle you into saying something which may be used against you as everything you want to put over is in the statement.

                BUT, should the matter progress as far as a trial (heaven forbid!) the prosecution will doubtless say that you refused to answer any of the police's questions (they will interrogate you even though you have handed over the statement) which may influence the jury unduly.

                The best thing is to give a full account to your solicitor privately before speaking to the police and see what they say.
