    Accused of Rape and domestic violence out on bail for 7 months now

    My ex partner of 8 years broke up with me in November and moved into Gingerbread, so I got with someone else who I had been seeing behind my ex's back for 3 years and found a new flat with her as my ex had ended the tenancy when she moved out leaving me nearly homeless. About a week later she kicked my new girlfriend out and moved back in after blackmailing me with my child saying that I would never see her again if I didn't take her back. Aswell as doing this she made me sign over the tenancy of the flat to her so that she could claim housing benefit and she was still claiming single parent whilst living with me.

    We stayed together until January when she decided to contact the girl she had chucked out and bully her into going to the police. They both went and accused me of raping them. My ex for over 6 years and the other for 3 years. The other girl dropped it a week later as she never wanted to do it in the first place and made a statement about my ex bullying her into doing it. And I have got back with that girl and she is now pregnant.

    Mean while my ex is still carrying things on with the police and I have been on bail since January this year. They took my phone and laptop for evidence and after speaking to my solicitor I have just found out that they have only recently checked the phone for evidence and they are now checking the laptop.

    Also my ex had me arrested again in March saying that I had tried to intimidate her and her friend in front of my daughter. The police checked cctv footage and saw that I had waved at my daughter and her friend was no where near. So that proved she was lying but they are still carrying on the rape and domestic violence case.

    Any advice would be greatly appreciated.

    Hi there.

    Please take a look at Casehardened's sticky thread: Been Falsely Accused: What to do now. It contains general advice on what steps to take now. You should use a solicitor who specialises in cases of a sexual nature.

    The police will still carry it through even though your current partner has retracted her claim as there is still an allegation to investigate. It takes a long time for phones and laptops to be checked and that is possibly why you are waiting for so long.

    All you can really do now is wait for those results but keep yourself alert in the meantime. Any evidence that might support you, keep it between you and your solicitor...do not give it to the police.

      As Faith says, the police will continue to investigate your ex's allegation once a complaint has been made. However if the girl would be prepared to testify in court that your ex had persuaded her to make an false rape allegation against you this will be a powerful defence.

      In fact, in your situation, I would consider asking her to make a statement to the police to this effect as it may well result in a NFA once the CPS have seen this (though first consult with your solicitor before you do this)
