    today my husband got charged for an alledged rape that happened 34 years ago , what happens now

    You now need to ensure that he has the best legal team available. This must be someone who specialises in defending false allegations of rape...where the alleged offence is historic, it boils down to one word versus the other. It is likely he will first need to go to a hearing in the Magistrate's Court where his case will be transferred to Crown. There will be further hearings, including one where he has to submit his plea before an eventual trial. A great deal can happen in this time, it is a long process, but you have to prepare for the very real prospect that he will have to defend himself in a court of law and be judged by a jury.

    Get a good solicitor (post your county and we may be able to suggest one) and they will then request disclosure of evidence from the CPS...including from an unused bundle. You will receive copies of statements from the accuser and any witnesses. Then you can start work on pulling these lies apart. All evidence you find is between you and your solicitor.

      Hi Thunderbird, I should think you're both shell shocked. As Faith says, have a good look round the site and if you have any questions - just shout up. Someone will be able to help you.

          If you can afford to pay privately have a look at the solicitor noted in my signature. He is much cheaper than many others and has a track record of getting cases chucked out before the trial has even started.

            Hi, haven't posted for a while, just wondered was the rape reported 34 years ago, I found finding information from a newspaper when the alleged rape was reported to the police was a great help in my husbands case. The police and cps were also a joke as when it came in front of the judge for a hearing before trial they admitted statements ect had been destroyed, this was after my husband had been on remand for 6mths. In the end no trial. Keep strong and your head held high.

              It is shocking and you must both be in shreds. My thoughts are with you both for a positive outcome. You'd think that something over 34 years ago with probably no evidence wouldn't go anywhere would you ..... you'll need an excellent legal team, the police and CPS love these 'easy cases' nothing to investigate really and things seem stacked against you but with help and support from friends and family and people like us, in the same boat, you're not alone.

                she didnt report the alledged rape to the police until march of this year , l just cant understand how they can do this

                  Is there any motive you can think of for her suddenly bringing this uo now?
                  has there been a fallout? Is she financially unstable?

                    34 years ago is a long time; would both he and the girl been adults at the time or would one or both been minors (eg. if he was under 14 it can lead to a different defence strategy)

                      he was 20 she was 18, the night he got arrested we had just opened a new business , he says he doesnt even know her , his brothers remember her but my hubby was older and not living at home he was living with his then girlfriend and they were expecting their 1st child

                        He needs to think long and hard about her, not knowing her is one of the worse defenses. His brothers knew her so if he wracks his brain he might too. Most likely its a consistence about the business and the FA, if he didn't know her, she wouldn't know about the business. Talk to his EX (if you can) see if she knows this girl it might help him.
                        Laugh at your problems, everybody else does. The last thing I want to do is hurt you. But it's still on the list.

                          They do it because they can and there is a lot of money to be made out of the tax payers purse in the form of 'compensation'.

                            hello everyone

                            well today my husband went to the magistraits and was given a date for crown court 6th aug, we got to look at the statements l felt sick after reading them , the alledged rape took place 34 years ago and l find it hard to understand why after all this time this can happen , lve lived with this since march and am finding it difficult to function , my husband is not capable of rape just finding it so hard

                              It must be a shock for you both to see the accusations written down as it appears to give them more gravitas; however, as is said about newspapers, just because something is written down doesn't make it true!

                              Your husband now has the opportunity to go through her statement, line by line, and list any inaccuracies, then in conjunction with his legal team, prepare a robust defence.
