    Hi Jock.

    Just read your thread. If lawlessone is right, which I'm sure he is, then congratulations.

    You sound like a very together kind of person, and well done for surviving this torture ordeal. Your accuser's finances sound like a pretty obvious motive.... and wow, to give someone a house....!

    Then again, I think like me, many accused will frustratingly never be able to fully compute the reason why.

    Season's greetings, and all the best for recovering as best you can in the new year.... One thing for sure, is that you are not alone. I found myself alive after nfa, and took up some rather over-extreme (for me) sport...... a grand time for new challenges, after getting through the days one by one.

      Hi everyone, thank you rights fighter and lawlessone for the encouraging words. I hope and pray you're right. They said when it was deserted that if it was going to be re raised, it would be done by February. I'll let you all know if and when it happens. As I said earlier,I will post a few more details in the new year when I get organised and it may shed a little more light for those members who are more legally savvy than me.

      Other than that, I hope everyone has the best New Year celebrations that they can and once again, thank you all for your help, advice and support.

          It's over at last!!

          Hello All,
          I know I have been remiss is keeping you all informed of my story.

          A quick re-cap:

          As you all know, my case went to the high court in Perth in November of last year, where the case was deserted "pro loco et tempore" (for the time being.
          I said I would post details of the case earlier in the new year, but I'm sorry, I just don't seem to have found enough hours in the day to accomplish everything I wanted to!

          Now the new stuff.

          I was re-indicted in February of this year and had to go back to Edinburgh for ANOTHER preliminary hearing! The interesting (and hopeful) fact that arose from this hearing was that one of the witnesses against me(who repeatedly broke down and went off camera during my High Court case), was certified by a psychologist that she should not go near a court again until she had successfully completed a course of treatment.

          The judge strongly hinted that this case should not proceed until this witness had completed this course, if she wished to do so. She was lying through her teeth about everything so this was her "get out clause" without risking being prosecuted for perjury should I be found innocent.

          I received a phone call from my lawyer tonight saying he had been contacted by my Senior QC and the message was that the prosecuting QC(Advocate Depute, AD) had e-mailed my Senior QC to say that the case against me was being dropped!!

          Their case was that shaky that they were planning to use the Moorov Doctrine (http://en.wikipedia.org/wiki/Moorov_v_HM_Advocate , http://www.scotlawcom.gov.uk/law-reform-projects/completed-projects/similar-fact-evidence-and-the-moorov-doctrine/ ) to prosecute me with. As they had lost one of their Moorov witnesses, their case had, in effect, collapsed.

          So basically, the upshot is, I AM A FREE MAN!!!!!

          I have spent 18 months of my life with this hanging over my head, my new wife's head and my family's heads.

          It is good, at last, to know it is finally over!

          Thank you to all of you who have provided support and advice throughout my sojourn into hell and back, there are no words that can express how grateful I am for it!!!

          My support goes out to all still on this forum who are going through the same hell I went through, and I promise I will visit at least once a week to offer whatever support and advice I can.

          Stay strong, stick to your guns, give your legal team EVERYTHING you can to help your case, and above all....BELIEVE!!

            Many thanks for your explanation, but I'm sure I will never understand Scottish Law in comparison the English system: if charged, likely to go ahead; not charged, won't, seems so much more straightforward.

            However I am very pleased that you are finally out from under this yoke, very best wishes for your future, and yes we would be pleased if you would continue to visit with knowledge and advice on your 'specialist subject'
