  • Urgent advice

Hi, I have read casehardened post and found it extremely informant but need some advice for a family member, I know the questions I am about to ask have been asked over and over, but we are all so worried, My family member was arrested and accused of rape by his ex, he said it was consenting and we have no reason to dout him, (forgive me for not posting all the details) he has to revisit the police station in 8 weeks as they need to make further enquires, as she took over a week to repot it, do we contact a solicitor now ? And can any one recommend a good one that is based in the south Wales valleys, many thanks to all that have took the time to read and respond.

Hi there, Gartsides in Newport - on Corn st. by the bus-station. I think the solicitor's name was Scott Bowan - he was recommended by Rights Fighter who has a lot of info at her fingertips about legal teams etc.

Thanks for your kind words & welcome to he forum.

As you mentioned further enquiries it sounds like he's not been charged. If not, a solicitor won't be able to do much as yet apart from offer reassurance, however there is no harm in researching a good practice just in case. Hopefully you will get some recommendations from members from personal experience.

Did he have a duty solicitor at his interview, if so did he offer an opinion as to if the case would go any further?

      Edit: to thank Jen

        Welcome to the forum.
You say that you worry about asking the same questions but as every case is different, it isn't a problem for each new member to ask them.

Immediately I would say you must have a solicitor. This needs to be a solicitor who specialises in sexual cases. The sooner you get a solicitor, the better.

Try: Morgans Solicitors and Advocates Cardiff

        02920 729888

        or Paul Jenkin from

        http://www.jnplegal.org/

        Merthyr Tydfil Office

        12 Church Street, Merthyr Tydfil, CF47 0AY

        or

        DX 53406 Merthyr Tydfil

        Main Fax: 01685 723654

        General E mail: Law@jnplegal.org

There is little a solicitor can do at this stage but if they are in place ready, then if a charge comes, you can start the fight straight away.
Now is the time to start gathering and collating evidence and timelines, you can't afford to be complacent. File this evidence for the solicitor's eyes only. Before speaking to the police, consult your solicitor first, every time.

What happens from this stage, is the police will continue gathering information with the view of getting a conviction. They will then prepare a file for the CPS who will decide whether or not to charge.

You will both go through a rollercoaster of emotions so you must stay strong for eachother and perhaps consult a GP for some emotional support.

Don't worry about posting too many details, this is a public forum which the police often look on so don't post anything identifiable.

My other advice would be to avoid the scary horror stories on here. Miscarriages of justice do happen...but anything can happen.

If you want to know anything else ask away. We are a very supportive community.

Thank you all for your quick response, I will ring the solicitors tomorrow and get him to write down all the details etc. Yes he had a duty solicitor, but I didn't ask him what he said, thank you all again

Did I recommend him? I don't remember the name.

Thanks Faith for the other recommendations - they are known to me.

Thank goodness you did not - I am sick to death of reading all the gory details when they are so unnecessary. I tend to avoid those posts.

Welcome to this forum and i am sure you will get lots of support on here.

If your family member is charged with an offence I can highly recommend Keith Evans Solicitors and Scott Bowen who works for them. I used them for my defence team against a false accusation a couple of years ago. They are based in Newport but they also have a few other offices around South Wales.
When I found out I was being charged the duty solicitor I had been using up until then just said to me on the phone you are being charged there is no point me being there at the police station when you turn up. Not what I wanted to hear but I also understand that solicitors don't get paid for this appearance.
I gave Keith Evans Solicitors a call and explained my situation to them and Scott Bowen turned up at the police station talked through the case with me at length before I was charged and gave me some excellent advice.

RFLH - The people on here helped me a lot when I was going through the mill, unfortunately the whole experience is still very much with me even after a couple of years after being acquitted so If I can just help someone a little who was in my position it is the least I can do.

Have you joined under a new name then?

Yes I have a new name. For anybody falsesly accused please do not understimate the importance of the advice given on this site as it could make all the difference especially for people who have not yet been charged and who do not understand the corrupt process. I would also recommend FASO.

Perhaps if you found time at any point, Westwood, you could post up a brief outline of your story in a new thread as it may help some of the members who are still going through it to read a 'complete' process

I put complete in inverted commas because naturally it won't ever feel that way to you. It does leave a permanent tarnish on your life.

Thank you all we had a meeting with jnp originally with Paul Jenkins, but he was delayed so we saw Tony, the boss, not alot he can do at present, but did scare us to death with the whole if convicted and sentencing speech, basically it's down to the cps, I just find it absolutely absurd that there is no evidence needed for an arrest or sentence.
