Falsley accused

I'll keep this to the point and as brief as possible.

Essentially 3 years ago I was an instructor in the Aircadets. Whilst there I started to go down hill a bit with drinking and due to being an it contractor I spent 2 months looking for work and generally being down. The ex also ended with me around that time. So all in all not looking good.

Anyway I was friendly with a female cadet (>16 years old), and regrettably tried it on with her one night. She said no, and asked me to take her home, which I did.

After the event I apologised and she accepted and I thought that was end of story.

Alas 2 weeks later I get suspended from the ATC due to that incident, and 3 months later I got sacked. (Police were involved at the time, but as nothing really happened they gave the case back to the cadets to deal with).

So I accepted the decision, got a new job and sorted out my life.

Until December last year when I am arrested for raping her!!

I had the Solicitor with me and gave my version of events on that night. When the police told me what she said it changed completely from 3 years ago. Everything she said in the original complaint was just about me behaving inappropriately by trying it on, nothing to do with rape. Also all of this info was take by the police at the time, and the air cadets also have a copy of the report.

As part of the investigation they took my computer, and the bail was 6 months, due up at the end of this month.

Are there any thoughts on how this might play out as I am starting to get worried a lot! (there is nothing on my pc), but worried they will take it further.

What is also odd is that I hear nothing for so long, I then did some music for my old Squadron last November as a favour, then 2 weeks later I get arrested. Wonder if that's her reasoning! According to facebook she is totally loving life!!! I also have mutual friends who can state she is an attention seeker, which is what seems to be happening here.

I did not even come remotely close to having sex with her!

Welcome to the site. Sorry you've been put in this situation, but there are good points in that the story has changed in the 3 years, and the original one is well documented.
On the face of it you shouldn't have anything to worry about in that regard. Having said that, the fact that no intercourse took place is not safe ground - all that is needed for a trial and a conviction these days is the word of an accuser with often no supporting evidence.

Look on the bright side - had you had intercourse with her, you'd have found yourself in the unenviable position I am now in - classed as something I'm not, because the jury chose to believe an accuser without any proof. Although 16 year olds can have sex, they are still classed as minors until 18. Thank your lucky stars.

Thanks for that. To be honest the only thing I am worried about is idiocy from the CPS and Police. I know I have not done anything wrong, but after reading some of the stuff on here about our "Justice" system it doesnt feel me with much glee!

In terms of myself I have just got on with life, and in that respect at the moment life is good (with the exception of the could over my head).

I guess it comes from the fact that I will not back down and will fight this until I am blue in the face. What annoys me thought is that to potentially fight this will cost me money that I of course will not get back. (Unless you can sue the CPS for taking something to court that was quite obviously a rubbish case?)

Does anybody know of any good Solicitors in the Brighton area? That do this sort of thing, I can easily google search but a personal recommendation could be useful.

The police have a duty to investigate!!!! , in the eyes of the law it’s assumed no woman would lie about this type of assault, but from bitter experience they do.
The fact that the girl has changed her statement is a big help. Make sure you get a specialist solister and stay positive; be prepared for a long wait though

Well I got an email from my solicitor today and apparently the OIC wishes to re-interview me on the 28th when my bail is up.

I must admit I am not especially looking forward to this as I was hoping for a NFA instead

If she's changed her statement then this is probably why you are being called in to be -re-interviewed.

Hopefully you didn't tell them anything that would disprove her story as that might be why she changed her story/statement.

Unfortunatley I did say things that disproved her story. The main one being that she claims she ran home after the alleged incident but I actually drove her home and gave a very clear description of this.
