  • What is the Investigation Process?

    Hi,

    Does anyone have details of the typical investigation process of a rape allegation?

    These investigations seem to go on for a long long time. Do they simply just wait for some magical evidence to pop up or are they really understaffed??

    I have been victim to a false allegation by someone. I was not accused of rape but conspiring to cause rape. I went out with a friend and one of his friends who I'd never met. I was staying over at his far from home. Me and my friend were waiting for a taxi when the guy I just met walked out the club with a girl, one I'd never seen before. We all got in the taxi and went back to my friends. This guy and girl went upstairs and presumdely had sex. When I went upstairs I could hear moaning from the landing. They came back downstairs and seemed off with each other. He asked her how she was gonna get home and she claimed she couldn't because her parents wouldn't let her in. He offered to drive her back and I said he can't do that cause he's drunk. He also offered ot pay for a taxi but she refused. They went to the end of the front garden and were talking for a few mins. Me and my other friend went up to check what was happening and he said she walked off. This is in the middle of nowhere and very late so I ran down the street looking for her because I didn't want a young girl walking around in the middleof nowhere on her own! I couldn't see her so assumed she had gone to far.

    Fast forward to the next day and this guy has been accused of rape and me and my friend was arrested on suspicion of conspiring to cause rape. I've heard they may have spoken to the taxi driver that night who would confirm she was not forced in the taxi and this guy and her were all over each other in the back next to me. I'm just curious as to what other evidence they could be waiting for? He has admitted sleeping with her so the forensics will show that they did have sex and that me and my friend were in no way involved.

    They have our phones and willl see I was texting and attempting to ring my girlfriend all night which will show I was hardly planning some kind of hineious act like that has been accused! I feel like I've just been in the wrong place at the wrong time.

    It's anyone's guess what goes into an investigation as each one is different, isn't it. They can take a very long time to get a decision though, so be prepared. From your story you sound like you're in a good position, but have an open mind with it and expect any decision.

      PalaciosDoe. It does indeed sound as though you were in the wrong place at the wrong time. Great advice from OEN34. He's right, every investigation is different and who knows what they do or how they do it?

      If you haven't already, you can write some notes for yourself outlining every detail you can remember about the evening, adding to it if necessary.. You can also have a chat with a specialist lawyer, there's a thread on here with recommendations, so that you can get some idea of the process in your area. Local solicitors are often clued up on how local police work and how long they take because it does seem to have regional differences. There are no guarantees but it might put your mind at rest a little. My man certainly felt better after talking to someone with legal knowledge, even though it didn't change the seriousness of everything.

      Prepare for the worst but hope for the best is a good mindset to have, but I agree that you do seem to be in a strong position with the police just looking for something to investigate.
