  • Convicted and waiting to be sentenced

    Hello all, I hope you all okay? this is my first post on this forum.. I hope to get some help...

    One of my friend has been found guilty and is taken to prison, his sentence hearing is in january but the solicitor is saying that he is looking between 4 to 6 years due to adding and abetting , he currently holds indefinite leave to remain in United Kingdom, could i please ask if its possible to send the person who has been convicted back to his country and serve the sentence there?

    Is your friend already a member on this forum; the reason I ask is because one of our member's trial has just concluded and we are wondering what happened to him.

    His username is 'stressed out' which seems linked to yours?

    The answer to your query is basically yes, depending on his country of origin

      Extremely Stressed - whereabouts in the UK was your friend living? As Case Hardened has said, it seems to be linked to one of our guys who was at trial this week and he was from up north. Is this where your friend is from?

        Hi extremelystressed, I think it depends on the diplomatic arrangements and whether that person would be at risk by going back to his own country but normally yes as CH has said.

          Would a prison outside of the UK be better for him to serve in than British prisons as I know in the UK a prisoner normally serves half of their sentence and conditions might be more humane than in other countries. Might be best to look up conditions of the prisons in the country he is from but it is normally up to the judge or prison authorities to make a recommendation for deportation. If he gets more than 2 years in prison he is eligible for deportation anyway and can automatically be deported by immigration after serving their sentence here on the grounds of public protection concerning the serious nature of the offence.

            It is not his brother who makes the choice as to which prison he goes to or in which country. He is better staying in the UK in case an appeal can be kickstarted. He can't appeal very easily from abroad.
