  • Question about an accusation

    Hi, a friend of mine has been accused of rape (historical, his ex-wife) but wasn't arrested or put on bail. The officer came to his house to inform him of the allegation, read his rights and asked him to come in for questioning. He was then told the case was going to the CPS but he wasn't going to be put on bail. Can this happen? I thought you had to be arrested and bailed when a rape accusation is made? I certainly was, so I find it hard to believe you would just be asked to accompany them to the station and be free to walk away at any time, and then not be bailed?

    Didn't happen in my hubby's case either! He wasn't even questioned until he went in for a voluntary interview! And then NFA'd!

      That's exactly how it happened for my hubby too, No arrest No bail, at the end No crime.
      Don't take it there will be no prosecution because of that though it could still happen when
      the case goes to the cps.
