  • prosecution witness against husband?

    hi, i've just found out that i have been called to be a prosecution witness in the trial against my husband. i have no idea why. apparently, it has to do with the statement i was asked to give in to the police.

    what do i do?
    i don't even know what the barrister's will ask me in court. i was not involved in the 'incident.'
    i'm really confused.

    It's possible that they don't want you giving evidence for the defence and one way to try to stop that is to turn you in a witness for prosecution. They might well "drop" you at trial.

      thanks RF, i didn't want to email you because i know how busy you are. but if they drop me at the trial does that mean the defence are able to have me as a witness or will it be too late? why don't the prosecution want me to give evidence?

        It's quicker to email me!!

        You are not a witness to the alleged assault so you cannot give material evidence, unless you have an alibi for him, which you don't otherwise you would have said so.

        Your husband can ask his solicitor to instruct the barrister to call you if he thinks you can assist the defence case. I can't see how you can do that from what you have said.

        My advice to you would be to sit tight and wait to see what happens.

        I know that doesn't stop you worrying but there really is not much else you can do at this stage.

          If what you know or whatever would really help your partners case.
          I would just go either way and when theyre trying to use u against him, itll be really for him, if you get what i mean

            i'm really scared to go. i have no idea what they will ask me or want to know. now that i've been made a witness isn't someone supposed to contact me and let me know what is going to be said???

              As I said in an earlier post all you can do is sit tight and wait. You are not a material witness as you were not present.

              I don't think you will be called.

              I think this is a tactic by the police to prevent you talking to defence.

              Your husband can ask his solicitor what is going on.

              He can then let you know, when he knows.

                the thing is hubby has been calling his solicitor and she hasn't told him much.
                it's not very fair for the police to be doing this.
                i doubt hubby will be coming out of prison.

                  since when have the police been known to be fair?

                  sadly this is par for the course when they think they're on a hiding to nothing.
                  And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..
