  • Rape after consensual sex. Help appreciated

    Hi all.

    I recently met a girl online, and ended up back at her house, and we had consensual sex.
    Went home after, and in the morning got arrested at home by the police as she claimed rape, and said she had agreed to sex, but asked me to stop, which she most certainly did not.
    She started acting weird half way through, and I stopped at hat pint without ejaculating, as it didnt feel right, the way she was behaving.
    There are obviously no witnesses, and am currently on police bail.
    My main question is would he CPS go ahead with this case in court as its more or less my word against hers?
    As you can imagine the last few weeks, my life has been upside down, and would appreciate any advice and support.

    Hi Chris - welcome to the forum but sorry you had to find us. You will get loads of support and advice, both emotional and practical.

    Sadly your story is oh so familiar on here. Have read of billykickass's thread. It may not give you the reassurance you seek in one way as it did go to trial - but on the other hand he was found unanimously not guilty.

    This may be a long and traumatic journey (I'm 3 and 1/2 months into mine) - some take 6 weeks, some take up to 2 years. It is impossible to second guess what may or may not happen though we all do it.

    Keep on here reading and posting - keep strong and we'll help all we can.....

          Im a realistic type of guy, but its a roller coaster for sure!
          However the work you guys are doing is second to none, and do feel a little better having even told someone else about it.....

              Week to go before bail date

              Hi Guys,
              Just wanted to touch base, and say thanks for running the site, as reading all of the posts must help everyone for sure!

              Week to go now until my bail date, worst time so far, as feel the decision of my fate is getting closer.

              Was hoping that it may have been dropped by now due to the consensual start, and my word against hers.

              Believe they have been awaiting medical reports, as she had vaginal bleeding, but I have slept with women before that have had this after sex.

              Would this be evidence against me? Or would that not prove anything?

                Hi Chris, welcome back.

                Don't be surprised if you're re-bailed next week - it seems to be part of the course and can go on for quite a while. The terrible thing is the swing of emotion this can provoke, so try not to go with any particular expectations. I think you can phone beforehand to see whether you're going to be re-bailed or not.

                As far as the CPS carrying on with the case though it's your word against hers... - it seems to be quite common, the criteria they go on to decide whether to proceed are:
                1. If it's in the public interest ('yes' , in the case of an alleged sex offence)
                2. Are there reasonable prospects of obtaining a conviction (estimated at 51/ or over).

                As for the medical examination relating to her bleeding , I think that's just to satisfy themselves that she wasn't internally damaged which wouldn't normally happen during normal sexual intercourse. As you say , bleeding after sex isn't uncommon and in itself doesn't prove anything - many women bleed after an internal examination.

                  Didn't realise I could call before, thats great advise thank you.

                  I will give the O.I.C that is on the bail form a call on Monday, the thing is you never know.

                  It could have been NFA,d or she could have pulled out and they probably wouldn't tell you as they have your clothes etc anyway?

                  I thought I had my head around it all, but its suddenly hit me again

                    You said you went back to her house, did you leave on good terms and did you have any contact afterwards, online or by text?

                    Having met her online you should make a copy of any conversations you had or anything else that might be relevant and keep it safe.

                    Don't be to despondent if it's a re-bail, as others have said it can take a while.

                      Just before i penetrated her she said just **** me, which I stated in interview.

                      She reached orgasm after about 5 mins or so then said just treat me like a piece of meat like the rest

                      I then pulled out without ejaculating and said to her this isn't right, I'm going home

                      She then through loads of obsenitys at me and i left.

                      On way home she text with something about i couldn't even look at her which i ignored, then accused me of theft of her house keys!! Which was rubbish.
                      She said she was going to ring the police about the theft of keys, police have seen these messages on her phone, and have siezed mine.

                      6.30am, police arrived and arrested me for rape.

                        I can reassure you that what has happened to you so far is the police procedure once an accusation of rape has been made.

                        Did you have a Solicitor present when you were questioned?
                        I really hope it is a NFA for you - it can sometimes be a slow process to get there for some but for others it is quicker.

                          Hi Izzy,

                          Yes had a Solicitor present, and to be honest they didnt grill me that hard was her view, and was all over in an hour. She also said I stole her house keys, which was rubbish, the Police drove me home after and did a section 18 search with my full consent. They walked in the house, walked round the lounge, then said thanks thats fine! Which made me feel they were just ticking boxes?

                          Anyway, bail on Thursday, just got to play the waiting game and see what happens, Sol said she will only be present if they interview me again, so guess she will be speaking to the Police before then?

                          Im thinking that if you do get bailed again its maybe a little good news, as they still have no evinence against you?

                            It's good you had a Solicitor present, hopefully it was a decent one who specialises in this area - if not, have a look at the Solicitor thread and see if there is one recommended in your area.
                            It is a waiting game and the timeline is different for everyone, so don't be suprised if it is a re-bail, your Solicitor could phone and find out for you before hand.
                            So she's thrown in a FA of theft to, she sounds very strange!

                              The re-bail can mean any of the following:
                              1: They haven't got around to looking at the case properly
                              2: they have referred the case to the CPS and are waiting for their decision
                              3: They are waiting for results of some sort to come back - forensics, phone analysis, etc
                              4: they think it's clearly a fabricated allegation and it's simply not at the top of their priority list.

                              Be prepared for a long wait. Many re-bails are quite common.
