At the end of January I had a consenting one night stand with a lady I met on a night out.
4 nights later I was arrested following an allegation of rape.
I was interviewed and released on pre charge bail. At the start of april bail expired and I was re-arrested for sexual assault during the same incident. I then was interviewed for the second time where they tried asking crafty tricky questions based on my first
interview.
I was told my case was being sent to prosecution service and they phoned me a month later to get the contact details of a friend who was with me when I met the lady that night and saw us dancing, drinking and kissing.
We had both been drinking in 3 different establishments and went for fast food which we ate on the way to my home.
We were both drunk and were refused entry from one pub and asked to leave another. She was more drunk than me but not really badly drunk.
We sat in a fast food restaurant waiting for food for appox 5 mins and from memory she was trying to fix her e cig. Police have the cctv of this.
We talked for a while once we did the 5 min walk back to my house and then engaged in sexual activity, I checked on 2 occasions that she ok with this.
When we both woke up, she seemed fine. She had no money on her so I gave her the money for a taxi. I also gave her a drink of lemonade and 2 anti-hangover milk thistle tablets.
I phoned her a taxi from my phone and we exchanged numbers.
From the 2 interviews, I gathered that she claims to have blacked out between approx 19:30 until we woke up at 6am. She was sleeping for at least 5 of those hours. She also says she only realised sex had taken place when she woke up.
I have freely admitted that sex took place. She actually said she is having flashbacks of it taking place in a different position which we did not partake in??
Im really determined to avoid being charged for something so hideous that I also did not do.
I used the same duty solicitor at both interviews. He has not done much during the interviews but has offered me moral support the odd time i have phonedhim.
If the police have tried (unsuccessfully) twice to charge me, does that mean prosecution servcoe
will also struggle?
