  • Contacting character witnesses.

    I want to contact a couple of character witnesses, should I need them down the line, & have a couple of quick questions :

    How do I ask them in a way that could never be construed as coaching? I'm minded to say something like......

    " Please don't share this with anybody, but I've been accused of rape, and I may need to you to act as a character witness. It's very important that what you say are your words, not mine, but something about me, in the context of the accusation I face". My solicitor will be in touch, and I'm afraid I can't discuss it any further with you".

    Secondly. How do character witnesses give evidence? Do they :

    1. Appear in person (& possibly face Cross examination)

    2. Swear an affidavit which is read out in court.

    & Thirdly The same two questions for witnesses living overseas...... Affidavits?, Video appearance?

    I should add, I think I've got a great witness...... I take lodgers in, and I had a very attractive 27 year old Romanian woman lodging with me for a year.

    I'd love it if she could appear in person, & the jury could see her & listen to how in all that time I never made a single move on her, or never flirted with her (which is the truth). I can't (& won't) suggest that she should say anything (has to be her words), but if she were to say that, the'd think I was a saint.

      Your solicitor should give you some guidance here.

      I think you are on the right lines with how to approach your witnesses but unless they are factual witnesses, there is nothing stopping you discussing the case with them should you wish ( although it's probably wise to keep details to yourself )

      A character referee can appear in court and some have felt that their appearance had an impact on the jury but they are often just read out by the defence counsel. They can usually just be emailed direct to the solicitor so no problem for those overseas.

      Character witnesses should be aware of the allegations but they should not refer to them, only your character, how long they have known you, what a gentleman you have always been etc..

      If you use "good character" then any previous convictions you may have will be revealed to the jury ( "bad character" ) .
