  • Is a change of solicitors so late into the caae advisable???

Ive started this on a new thread as its a straight forward question and would appriciate some advice or suggestions on.

I am just wondering if anyone has any experince changing a defence team that you have became increasingly unconfident in,
    so close to the trial.

We are seriously thinking of changing to another sol but is this advisable with a trail date looming in the mid-November??? The new sol has expereince of our specific case and we have been recommended by a friend who used them for there case.

The current sol that we using was the duty sol but each day my confidence is beconing lost. It is my sibling that has been charged (with serveral accounts against them) but they do not have the capacity to understand or make such a decision themsleves...so I feel that its all down to me.

The pressure is huge but since July this year I have not been feeling that we have been listened too by the sol. I feel thwy have bacame increasingly lazy and not paid enough attentuon to what we have been saying to them...all in all something isnt feeling right here?!?

What are peoples thoughts?...has anyone ever came across this situation? My gut feeling is to try another sol (or at least have a half an hour free chat). If they would agree to take on the case then I would jump at the chance if honest .

This is beacuse I dont want to ever regret not trying for my sibling .if I didnt try I would regret this for the rest if my life. I'm thinking this could be the difference between them going to jail or not. Oa I just being irrational and not thinking striaght.

This website explains the situation fairly well:

NB This is not a recommendation for the firm sponsoring the information but the site won't let me cut'n'paste the important bit!

Ten years back it was a lot easier to cite a lack of confidence in the legal team and instruct fresh. Now it is almost impossible.

Some people have tried that, with the fresh reps willing to accept the case and the current willing to let it go, and have failed.

Put your points of concern to the senior partner in the firm and ask why they are not liaising with you, given the problems with your sibling.

It could be that said sibling has not authorised you to liaise or you need a power of attorney, which is a bit late in the day at this stage. But first things first, write a sensible list of things you need to know, which evidence you think should be put and what the perceived failings are of the legal rep.

Do this in small paragraphs bullet-pointed so it is easy and quick to read.

Rights Fighter thats a ckear and concise list so I can prepare myself. I have just had a telephone call from the secretary cancelling tommorrows appoinment with the current sol and has been moved back to next week. This would now makes it less than a month to my siblings trial.

I've used the "ignore" function on Blingguy's posts and threads so I can't see the rubbish he has written. Unfortunately I can still see that he has posted 'something'.

Please do be careful when considering anything he might suggest. I have a feeling he is involved with somebody who has caused a lot of heartache for many people.

Anyone who needs genuine legal advice I suggest that you ask your solicitor.

Thanks for that very kind info, Rights Fighter... I have consulted legal advise...can I ask can I use that button too? If so how....

Alo can one of the mods delete blingguys and my convosation as well please.

As we can all appriciate, I have got too much on at the moment and do not need this added silliness.

To use the ignore function go to your settings.

On the left hand side you will see a panel and "Edit Ignore List" close to the bottom. Go into that and then add the username to the list and "Save changes".

I'll add you as a contact so you can PM me. I am out all day though but if you do message me I will get back to you.

Edit: I've just sent you an email. Check your spam / junk filters in case you don't receive it into your inbox

Was good to speak with you this afternoon. Hopefully you received the attachments and you will speak to the senior solicitor tomorrow. If you don't get put through to him, write a letter and hand deliver it, marked "For the personal attention of Mr [senior solicitor's name]".

Let me know how you get on tomorrow afternoon.
