  • My Story ... Start to End...Please read!

    Firstly I want to thank you all for your support you have offered me over the past few months. I have not been adding any comments to the forums but the daily reading has made me feel like I am not alone, and I am not the only soul going through this hell.

    I only want to give brief details of my case as I feel it should stay in the past where it belongs.

    Earlier in the year I was falsely accused of Rape. As is echoed around this forum, I can only describe it as the most challenging period of my life. I met a girl and after totally consensual sex, we left on very good terms, with her maintaining contact after. A few days later it became clear that the police where looking for me after visiting my home and leaving a message with a family member. I am a professional man and the impact of this allegation of my career, family and wellbeing was immense.

    When interviewed, the facts laid down by the FA, were a pure work of fiction and I still to this day do not understand her motivation. I didnt even know the girl apart from minor conversation prior to meeting. I spoke honestly and openly to the police who were very pleasant.
    Throughout the investigation I truely believed the FA would see the light and confess to the police. This of course never happened. Maybe I have never been exposed to this type of evil before.

    Anyway, I was thankfully NFA after just over 8 weeks and I cant begin to tell you the relief. From reading around the forum, this is very quick compared to most. They seized my computer and phone, but I can assume from the time of investigation, they might not have been checked. The most heart hurtful thing about the whole affair is that the police never process your innocence and you still feel that the truth has never come out.

    My advice to anyone in this position is this.....

    1.GET A SPECIALIST SOLICITOR in this area. They will both guide you and make you understand what is the process ahead. I highly recommend Gerry McDonald ( EBR Solicitors). If you can afford it engage with a specialist such as Gerry as early as you ca. As my initial interview I had a duty solicitor, but changed to Gerry after a discussion with him on the phone. ( Got number from this site)

    2. Start gathering evidence as soon as you can. Pick yourself up and dust yourself down... the fight is on. Don't get me wrong I has many tears and dark moments, but with the help of Gerry we highlighted additional areas of investigation which certainly gave the impression we were building a early defence. Check online, save texts, emails, messages, photos... anything!! Remember this evidence could disappear when you head is down..... get looking (obviously following bail conditions). Write everything down ... and I mean everything.

    As a professional man, my career was threatened by this evil FA. With this mark on my ECRB it would be game over for me... so as soon as I was NFA , the fight Part 2 began.
    I asked the police force in question to consider the deletion of records of my arrest, as allegation was completely false and nothing to do with my work. I also asked for DNA and finger prints to be removed.
    I drafted a letter, g0t it reviewed by Gerry and sent it away, sighting a number of High /supreme court cases supporting my angle. I also focused on humans rights article 8. The letter was balanced as not to be too heavy handed.

    The answer, whilst not completely satisfactory it is acceptable and sensible by the police .
    With the new Protection of Freedoms Act 2012 they are trying to keep all arrests but reduce the threshold for disclosure of certain information, such as arrests. They agreed to not disclose the allegation on my ECRB and delete by DNA/Fingerprints just after the summer.

    Gerry did mention to me that they might be about to revisit this in the near future with current cases going through the courts. I will try and get the records of the arrest completely deleted in the long term. As a innocent man, thats what I deserve!
    In the future I am happy to share the template I used to get this reasonable result.

    Hi lookingforhope - great post full of good advice and sooooooooooooo pleased for your NFA - wonder if you have spoken to Gerry to get it commuted to No Crime?
