    Hello I will try to keep this brief, thank you for taking the time to read.

    I have been arrested for a charge of anal and oral rape dating back nearly 10 years.
    The police disclosed nothing to me initially other than being arrested for rape, the city (not where) and the date.

    So for 3 interviews I was advised to pass no comment. BTW - I have never raped anyone (maybe stating the obvious).

    At the end of my 3rd and final interview the officer reveals all the grim details....
    Oral and anal rape, exact location and DNA linking it to me.

    My defence is simple...
    We had consensual oral sex. It looks like her boyfriend has found out and she has made some story up which he didn't believe. He has called 999 being scred for her and she has then carried on with this farce. 5 days later she asks for it to be dropped.


    So, we have now got the evidence through and what a load of nonsense.
    Police statements from 10years back contradicting themselves.
    Her boyfriend, the one who called 999 contradicts her story.
    She first claims she was raped by 4 men. Then changes it to oral rape by one man and then in 2014 when I have been matched to the DNA 10 years later she claims oral and anal.
    Sperm was only found in her hair. Nothing in the anus, vagina or mouth.

    I know this will go my way in court but I would like to fimish this before it gets that far. So here are my questions.....

    They have lost the original DNA swabs they carried out on her.... All of them!
    Can we throw this out?

    How about "abuse of process"?
    I recall texting a number in my phone the following few days... If this was hers that would have been a strange thing for a rapist to do. But the police didn't obtain anyone's phone records and a large part of this case is about phone calls that took place at the time.

    So she's decided to resurrect the allegations then it seems.

    How confident are you in your solicitor and has a suitable barrister been instructed yet?

      How do you judge solicitor competence ?

      Similar situation going on for us .... Aged case reopened and our family in bits .... Never been down this road or knew how easy it was for false accusers to do this to people .. Thing is we have a good barrister (I think) albeit expensive & eating up our pension ; she did manage to get our innocent son bail... Solicitor just keeps telling us to wait : they have to prove him guilty ; not us to prove him innocent .... but I can't help feeling we should be looking for evidence to prove his innocence. Is it me ? I dont t know what to expect from the solicitor as it's usually me calling him: cps evidence not here for example but he's not chasing for it as he says it makes the look incompetent . Any view ?
