  • maximum sentence for sexual assault??

    hi, can anyone tell me what the minimum/maximum sentence a person would receive for sexual assault??

    my husband is still in remand, bail has been refused yet again. we have another hearing in december. they said it will be by video link to the crown court?? i don't know what that means.

    but i'm preparing for the worst. just need to know what will happen when/if he gets convicted...

    can anyone help me please??

    completely alone and scared.

    I am not 100% sure on this, but if he is accused of Indecent Assault, the sentence can be up to 10 years. As for the minimum, well it depends on a number of things. My husband was sentenced to 1 year, of which he served 6 months. At sentencing the judge said he had no doubt that R was a "hardworking family man" but that because he had pleaded Not Guilty, there was no option but to impose a custodial sentence. I also read about a man who attacked a female passerby in a churchyard, indecently assaulted her and then "finished" on her face. He pleaded Guilty and got a suspended non-custodial sentence.
    there was also an article in our local newpaper a couple of years back about a teacher who had indecently assaulted 2 pupils, and the police found a stash of child porn on his computer. He pleaded Guilty and was given a non-custodial sentence.
    So I'm afraid it is a bit of a lottery.
    It is absolutely normal for you to feel alone and scared. Why has your husband been refused bail? this is pretty unusual, unless he is a flight risk, or lives very close to the accuser and has nowhere else to stay. Have you got a good solicitor? It is essential that you appoint one who is experienced in sex crimes - a standard criminal solicitor will not be good enough.

    Your husband will appear via videolink for his next appearance - this just means that he will not be physically at the court, but will be put in a room, presumably at the prison, and will speak to a camera, which will then transfer the video to the court in real time.

        Thanks for you reply. the police have said that if released on bail he will not return to his hearing and maybe commit another offence.
        our solicitor has just sent me a letter telling me she has moved another bail hearing to the crown court. does that mean it's good? i really don't know or understand the justice system. i'm so confused.
        i haven't told my family, they would not support me. they have only just gotten used to the fact my husband is black. i'm completely alone.

        my husband was cautioned last year for a similar offence. he was talking to a girl, grabbed her arm, she thought something different then freaked out and flagged down a police car.

        i'm going out of my mind.

        the solicitor said to me things are not looking good.

          These days playing the "black card" does not work. I've returned from a visit to a prison today to be told that prison officers are reluctant to reprimand black prisoners in the visits hall as they are worried they will be accused of racism.

          Being remanded has nothing to do with your partner being black. I would say it is more to do with something else relating to the previous caution and/or something else.

          If the solicitor knows more than what you have said here, then I would agree with what he or she said "things are not looking good".

            RF, I think KSKC was referring to her parents having difficulty accepting that their daughter has married a black man, not that the legal situation is due to his race/colour.

              I realised my mistake shortly afterwards when I went back to re-read my answer. However I have been in touch with with kskc via PM and there isn't much I can do, if anything, due to the circumstances of the case.

                thanks for your reply RF, i think i am beyond help. i'm so close to giving up altogether. i don't have the energy to go through all this. how come there are so places you can go for help if you are victim and nothing if you are partner/family of the accused?
                i doubt anyone can help me anyway.
