    Hi

    Ive just joined after several months of being arrested and interviewed for a false allegation of rape. I couldn't even google this since my arrest and interview , somehow ive made it through to this year and through several dark, depressing, terrifying, painful and paranoia-induced months, I'm here.

    In my case, I'm waiting for the police (or CPS ) to decide what they will do with me, my main source of optimism (although I'm not sure of its importance due to my worsening mental state), is i'm glad my accuser's texts have been seen by the officer in charge where she brags of having plotted against me, trapped me and even saying she'll ruin me.

    Anyone advise me how good this evidence is to me ? I think its good but my mind's playing tricks on me so I don't know what to believe anymore.

    In the good old days the police were allowed to make up their own minds and end cases if they felt there was nothing to answer. Unfortunately in this Mad, PC, BELIEVE THE VICTIM world we live in now the police are not allowed to use their intelligence any more and have to pass the case on to the CPS. Well the CPS has to check the case passes two tests 1)The Evidentiary Test 2)The Public Interest Test. That Evidentiary test is to see if there is enough evidence to ensure a conviction. It is at this stage this stage that they should look at the texts messages you mentioned. They should then realise that these messages will create enough reasonable doubt in a juries mind that you will not be convicted.

    Those of us who have logically minds and have a ounce of intelligence, who look at these texts and say, "there is no way we are going to get a conviction!" Unfortunately were are talking about the CPS here, who are a branch of government. Even though there job is to uphold the law and seek justice they have forgotten this and now think their only job is to seek convictions. This leads them to treating FA's with kid gloves, allowing them to provide false information, to claim compensation before a crime is proven etc, while treating us falsely accused as mad psychopathic guilty until proven guilty perverts.

    The best approach is to make sure the police and the CPS, know you know about the texts, so they cannot forget to disclose them or loose them down the back of the sofa. I actually offered copies of texts to the police and the CPS but they said they had to get them from my phone themselves. I was surprised at this because of the number of cases I have read were the FA's supplied edited copies of conversation to the police. I don't understand why the police would accept evidence from the FA but not us accused, that seems biased to me.

    Anyway rant over. I am sorry that your mental health been so badly effected. The advice I have found on here, is stay active, occupy your day, keep in contact with friends, seek support from family and mental health groups as well. I have always been a bit quirky myself and this whole experience has just made it worse.

      Does this mean it's of no use?

      The accuser sent the texts to a mutual friend who has shown them to the police, surely these will help show I am the victim here, not her ?

      Didn't a couple of trials recently collapse due to similar texts being found last minute ?

        No I am not saying they are of no use, they are very useful indeed. What I am saying that in used to be the police would see these texts and then end the case straight away but not now. The CPS has to see the file and from the experience of other members here it will take them sometime to act. The CPS should realise that the texts will cause enough reasonable doubt that you will not be convicted and therefore they should decided on No Further Action.

          Echoing Pond31 here and adding that what should happen and what does happen are sometimes two different things. As security, does the mutual friend have screenshots of these messages and do you or your solicitor, if you've spoken to a specialist, have copies? On the face of it the texts are excellent evidence, but having such evidence in your own hands might give you a bit of piece of mind while you endure the wait for an official decision.

            Thanks to you both for your helpful replies .

            The mutual friend has let the police see and print out the texts and also provided a witness statement to the police backing me up and the police has printed out the texts and got the my friend to sign the printed texts ...

            The police has had the texts for a couple of months now and the Friend has still got the Texts on their phone

              Excellent! I hope you get a sensible decision soon. For added security, you could ask the mutual friend to back up her phone to her/your computer, just in case her phone gets lost or the texts get deleted by mistake or something. (Belt and braces kind of thing.) Keep popping in here for support as often as you need. Unfortunately, the time-span ends up feeling as though you are wading through treacle, but you're not alone.

                Adding to Frantic's advice. If your friend has a Android phone then the simplest App to use is SMS Backup+. You link the App to a Gmail account and the App sends copies of the texts to that gmail account. I think you friend should then send them to you via email. You can then access them anywhere and or print them out.

                    I would say if you have messages from the FA saying she is going to get revenge on you etc than I suspect you can be optimistic. As I for case.

                      NFA'd at last

                      After 2 and a bit years i was NFA'd and i'd lost the log ins for this site and didnt want to re-register etc, anyway, thank god i was NFA'd.

                      I am an overthinker anyway, and suffer from depression anxiety and paranoia since childhood and the evil false accuser knew this, and wanted to ruin me in every way. She lost.

                      Every day felt like hell and i couldnt sleep even with my pills, i was on strong anxiety medication, no help at all. I was in panic mode 24/7, my family would tell me it wont go anywhere, but my mind wouldnt agree.

                      No matter how much support i got, i felt alone and isolated. Felt like the whole world was free and i was tied , burdened etc

                      Thought of suicide a few times but then somehow didnt go through with it.

                      In the end, the case officer, who was very arrogant and deliberately slow, wouldnt return my calls or texts for over 8 weeks so i began calling him twice and three times a day, then after a further month, he called me and told me id been nfa'd. He sounded frustrated like he wanted to personally punish me, i read other people experiences and their case officers are people you can approach or talk to, but this guy was just arrogant and rude.

                      Anyway, i want to thank all of you especially Peter1975, Pond 31, frantwithworry, thank for your support and supportive words when i was this close to calling it a day. God bless

                        Thank you so much for finding your password, coming back and letting us know the good news. I'm so glad you survived the ordeal too. It cannot be underestimated how terrifying this experience can be, but you got through it. :-) :-)

                        I'm sorry to hear that the officer was so unpleasant. I think, some of the time that it's due to their disappointment at not getting a 'result' or whatever the jargon is, and they are under the pressure of targets and so on, but that's no excuse. There are too few officers who are really interested in the truth.

                        Still, well done for surviving this horrible ordeal and thank you again (for the kind words, too).
