    Hi

    I may have asked this already but I have forgot. I was wondering if the CPS prosecute a false rape case, were they know there is little or no chance of winning, because they were pressured by the DPP to up the level of prosecutions, could this be considered a "Malicious Prosecution"?

    Even if that met the definition of a malicious prosecution (and I'm not sure it does) - it would be very very difficult to prove and would require very deep pockets.
