  • Advice needed please

    I was on the verge of suicide and have tried 4 times already to no avail as a case I have against of rape has completely blown my mind but anyway after the information on this website from a person detailing his ordeal and suggesting the above named solicitors who's PA has been amazingly helpful I just wanted to say THANK YOU as I feel less suicidal and a bit of hope for myself.

    I'm so sorry to hear that a false accusation has affected you so badly, but so glad to hear that you have finally found some help and support, so you now feel a bit better.

    I hope that the improvement in your state of mind continues and that you find lots of information, help and support, from both here and the solicitors. You re not alone - a cliche, I know, but true, and we are all here to help and support one another.

        Hi, would the police tell your ex partner what day they are going to arrest you if you are out on bail?

          I doubt they would give notice of an intention to arrest. They would tell you in advance if they wished to ask you in for a voluntary interview. Make sure you have legal advice if this is the case. It is not unheard of for plod to arrest when one turns up for a VI but they need reasons to do this and VI's, under the guise of "a friendly chat" have become the norm.

          don't trust them an inch and say nothing without a good sol present.

                Just a bit of advice please

                I read on this forum to document what you remember etc...

                Do I take the information with me to the police when they take me in for questioning or do I give it to a solicitor ?

                  Sorry I forgot to mention I have aspergers and my mind is hazy a lot of the time so to follow conversation is really difficult for me, this is why I asked about showing what I remember to whichever party as above, thank you.

                        Sorry I forgot to mention I have aspergers and my mind is hazy a lot of the time so to follow conversation is really difficult for me, this is why I asked about showing what I remember to whichever party.

                        I took advice from a post on here jotting everything down I can remember, should I show this information to the police or the solicitor as apparently they are looking for me so I contacted the CID but there is no arrest out for me. I asked OIC but no reply yet from OIC. CID said to me just be ready just in case so I guess I am going to either have to try and stay awake all night which at this moment in time I am finding really hard as exhausted now or sleep downstairs with the door open because I don't wan't them breaking it down when there are dog's in the house.

                          Can I or is it wise or not to talk about your case on here, I am completely lost, have not eaten for 3 day's, scared to go out and the only person that has stopped me committing suicide (though I have flipping well tried 4 times now with pill's and knives to no luck) is the PA from Chris saltrese solicitors.

                            Never hand anything to the police without the advice of a solicitor. Which area are you in?

                              Show what you have written to the solicitor, not the police. You need to discuss with your solicitor whether to answer their questions or provide a written statement. Do you have a good solicitor or would you like a recommendation?

                              They are far more likely to invite you in for a voluntary interview rather than arrest you so you should be fine going to sleep.

                              These are the reasons needed for an arrest:

                              (a)to enable the name of the person in question to be ascertained (in the case where the constable does not know, and cannot readily ascertain, the person's name, or has reasonable grounds for doubting whether a name given by the person as his name is his real name);

                              (b)correspondingly as regards the person's address;

                              (c)to prevent the person in question—

                              (i)causing physical injury to himself or any other person;

                              (ii)suffering physical injury;

                              (iii)causing loss of or damage to property;

                              (iv)committing an offence against public decency (subject to subsection (6)); or

                              (v)causing an unlawful obstruction of the highway;

                              (d)to protect a child or other vulnerable person from the person in question;

                              (e)to allow the prompt and effective investigation of the offence or of the conduct of the person in question;

                              (f)to prevent any prosecution for the offence from being hindered by the disappearance of the person in question.
