            I got my property back from the police. I discovered that my children's Mother has been living in Thailand since September. That's 4 kids she's walked out on in total.

            Now to my last concern. DBS checks for employment. Once my kids are both in full time preschool, I'll be wanting to go back to work. The type of work I do involves an enhanced DBS. The OIC told me the allegation will show on an enhanced DBS despite being not guilty, no charge no bail and my ex admitting she lied. Surely this cannot be true? Even my solicitor is confused. I've done nothing wrong, quite rightly been cleared of a malicious attempt to divert attention from a serious assault on me, and now this will ruin my career due to an allegation that is pure fantasy?

            If someone knows anything about this, whether it'll show on an enhanced DBS, and if so how do I request it be wiped off? Because even if though it's an allegation and I can prove I'm not guilty, that won't suffice due to the stigma etc.

            I'd be grateful for any advice here.

            • Enhanced check

              There is an police term called soft intelligence, this is information they hold on you that covers such things as allegations made against you, even when there was no case or charges. The enhance check includes a box where they can put things in such as allegations etc. You have no control over what is put in the box. You can have no charges, no convictions or even no parking tickets but they can put this soft intelligence in there.

              The reason this was done was because of case such as Ian Huntley who moved from one police area to another and allegations did not follow him. This then allowed him to get a job as a school care taker and murder the two girls. He had not been found guilty of anything in the other police areas but allegations where made. There was such an outcry afterwards that they decided that checks needed to include details held in soft intelligence.

              You can ask any enhanced check to be sent to you first and if it holds any details you judge untrue or that are not needed I believe that the details may be removed via the appeals process. You can also ask your details, dna and finger prints to be removed from the police national computer, if you have not been found guilty of anything else, after a certain perioid of time. This is done by contacting the chief constable of your area. The time peroid for my area is three years.

              • Pond gives a good example of Huntley and the reasons that allegations that have not been proven to be untrue be included on an enhanced dbs check. One would hope that someone can be made to see sense in your case.

                It's my understanding that this information should be relevant though and a NFA should only show for those who work in sensitive areas, ie with children or vulnerable adults.

                You can get early warning of anything that might appear by joining the dbs update service which costs £13 per year :

                There is an appeals process, the first step of which is the chief constable and if there is no joy with that the next would be the information commissioner's office if you can't afford a solicitor. I'm 99% there is no legal aid for this but please check.

                In England and Wales, if you weren't arrested or charged, there is no process for early deletion of your biometric data as it will be removed from the PNC automatically unless the police apply to keep it, in which case you will be notified and given the opportunity to challenge this:

                  My line of work is with vulnerable adults. So I guess it's tome to look for a new career. I get the Huntley thing, but it's unfair and quite daft to have this one size fits all approach.

                  Social services have done the same with baby p. They use that case as an example to destroy families yet the amount of children removed for physical abuse is a drop in the ocean compared to the amount of children removed for 'risk of future emotional abuse'

                  I've done nothing wrong, had my reputation damaged and it now seems to have impacted on my employability. There should be compensation for stuff like this.

                    I must say you are giving up rather easily, it is up to the chief constable what is disclosed and that can be challenged with the evidence you have. A pain I know but I would say you have a good chance of being successful.

                    Perhaps you have had second thoughts about your career making you more vulnerable to false accusations in the future which is understandable but a shame nonetheless.

                    • I know that it seems as though dealing with all this is a never ending battle but don't give up yet, nosleepforweeks. I agree that the system is broken, but we have to deal with it as it is until it is fixed, which isn't going to happen any time soon. In the meantime, don't get despondent until you've put in the necessary work. The OIC is not correct, I've come across several people who have said that things that they expected to be on their enhanced check are not there. First step is to get a copy of it for yourself and to see what if anything is actually there. If there are things that should not be, a letter to the Chief Constable, often does the trick. If s/he is unhelpful, a letter/surgery visit to your MP will put pressure on him/her to put things right.

                      I know it's a pain and I know you shouldn't have to go down this route, but you've done so much and come so far, this last hurdle can and should be overcome in short order. It's the last one. Don't give up now.

                      PS I hope your wife being in Thailand is giving you a bit of peace of mind in terms of her re-appearing in your life any time soon. This is the last thing you need to do to get your life back on track for your children.
