  • Cps requesting family court witness statements

    Hi the police have informed me that they will be making an application for all family court material/statements made by both me and FA.

    I am on pre charge bail and I was curious as they mentioned I raised inconsistencies in her statement so I was hoping this is good news as it seems like they want the hard copies of what was said but then I read s119 of an act says they can request this information to admit as evidence for her.

    My point is the statement she gave police is inconsistent with the one in the family court for injunctions does anyone know the significance of this as it seems thy want the original.

    They are inconsistent statements she made but I'm reading conflicting articles some say it's good for me some bad and is pre trial stuff can anyone advise i really appreciate it.

    A year and 2 months on bail

    If you have been consistent and she has not I can only imagine this is a good thing but it will depend on what she has been inconsistent about. As you have highlighted these inconsistencies in your interview it would be seriously negligent of the cps not to check and there is likely no agenda behind this other than seeking further information with regards to making a charging decision.

    Even if elements of the FC transcripts support prosecution, the ones that undermine her case can be used in your defence.
