      Hi Fusiondoe - I wouldn't be surprised if you were re-bailed - this can go on for months and months and I think in most cases it does. It's early days for you still, I think. Although it is agonising, you are probably going to have to accept that you're in for a long wait. Why not ask your solicitor to phone the OIC before the bail date to see how the land lies? I think the consensus is that people get told via the solicitor - I asked the same question myself. But then, I've also heard of people being informed by letter and phoned by the OIC directly.

        I sort of figured I might be rebailed, sorry to keep asking so many questions guys! Maybe I'm in the minority but, I have to talk about the case in order to stay sane! If I ignore it to much or go quiet then I overthink!

        It's frustrating because I know in my heart of hearts there is not a single SHRED of evidence! It is completely my word against hers, so in an ideal world I should get NFA or NG! I just have this feeling that somehow I am going to be stitched up! Probably my own fault for reading horror stories all the time I guess

          So I have just had the Solicitor on the phone and I am being charged it appears.

          I am fuming!

          There is no evidence for a start.... My solicitor is very confident I won't Be convicted and that our case is very strong

          I am so angry! This is ridiculous, I did nothing wrong to this stupid girl

            So sorry to hear this FD,
            It's so unfair.
            You will be angry for a while but try and channel that into your defence.
            You've done nothing wrong.
            You'll have all sorts of other emotions too.
            But you will get through it.
            Get the best solicitor you can, a specialist in these allegations is always best.
            You only get one shot at clearing your name so make it a good one.
            Take a deep breath and prepare for the legal battle.

              I'm so sorry to hear this fusiondoe. Don't despair though. Many people prefer this conclusion to a NFA letter as it gives you more of a chance to show the lies up for what they are and to clear your name more completely.

              If you have confidence in your legal team and between you, you put together a good case, you have every opportunity to show this girl up for what she really is - a false accuser. I don't wonder that you're fuming though; just channel the anger wisely.

              There are many here who have been through the process and we will all support you as much as we can.

                I could scream honestly! Even my solicitor said that this is a blatant case of the police charging just because it's a sex allegation.

                I am fairly confident with the solicitor I have. He is a great guy and has represented these sorts of cases before. It is also nice to have a solicitor whom genuinely believes I'm telling the truth.

                I am just so angry.

                Surprised though I wasn't rebailed once like some people who are bailed several times.

                I guess now the fight begins.... I do agree that I am looking forward to clearing my name as opposed to just getting an NFA but I can't possibly see what evidence the police have against me, there just isn't any!

                  I asked this very question and the OIC replied "yes we do have evidence, the complainants statement"

                  You couldn't make it up, imagine this in any other sort of crime except SO, the complainant would be laughed away from the front desk....

                  It's good that you are a little angry, this will sharpen you in fighting the accusation and do always remember that the jury are not like the police & CPS but will be composed of sensible folks like you and I!

                      so today I was charged. The officers were (as expected) complete a-holes to me.

                      I have been charged with 1 count of.... I quote

                      Sexual assault on a woman aged 16 or over by touching that was sexual when she did not consent and you did not reasonably believe that she was consenting.
                      CONTRARY TO SECTION 3 OF THE SEXUAL OFFENCES ACT 2003

                      My hearing at the he magistrates is 17th Feb at 9.30am

                      I am broken and livid.

                      Somebody tell me I am dreaming?? Somebody please tell me we are in the matrix and this is a game

                        From what I understand FD these days CPS standard practice is to charge in all sexual offence cases. So you are in the machine. That is what it is.

                        I was pushed out of the criminal machine very early on, but others have gone all the way. So my comments are limited by my experience.

                        You have my support FWIW.

                        Keep fighting as I am sure supportive posts will be following presently Take heart that the forum are here for you. You are not alone.

                          Really sorry to hear this Fusiondoe. In what way were they a-holes to you? I don't know much about the 2003 act, but reasonable belief is not the same as honest belief i.e. I think they like to see evidence of acquiring consent. Can the text messages you exchanged be used to defend you? There might be a suggestion of her coming on to you in those words perhaps?

                          And...you are not broken. You are going to take the punch that you have been given and then you are going to stand up and defend yourself in a couple of days when the shock has left your system. Gather all the evidence you can and I wonder if your partner might be able to help you in your case?

                          Go easy on yourself. Easy for me to say as I've not been charged (yet?). Rely on support of the members here and I hope you have a specialist solicitor?

                              It has to pass the threshold test 51% chance of conviction. Bit I believe they prefer to,put cases in front of judge/jury for them to decide wherever possible
