  • Abuse of Process

My case was from 1985 and concerned an allegation of abuse to my step daughter. At the time it was dismissed by Police as having no substance. I was interviewed and she had statements taken. Then as is by magic it resurfaced again in 2014. It went to court this time, however the Police could not produce any evidence by way of Statements, Doctors or Social Services reports nothing. At my case management hearing the Judge advised my barrister to apply for a stay on the grounds of Abuse of Process. The judge granted this and stayed proceedings. My question is can, it be resurrected again some time in the future, or is that the end of it.

Unless some very compelling evidence comes to light I would say that that is the end of the matter. Given they resurrected the NFA with what appears to be no fresh evidence, I doubt they would try that again (in your case).

Thanks for the reply RF. It sticks in the back of ones mind whether the nightmare will start again.
