  • FFH Fact Finding Hearing - Any advice?

    Good morning Ladies & Gentlemen

    Given I have a FFH very soon., May I impose for any FFH or trial advice that has proved useful? I had a meeting with the Barrister that really has not inspired confidence (despite innocence but what is that in a Court of Law ? Just a badge for the naïve). So looking to the "wisdom of crowds" for anything to assist.

    Simple, straight forward & something than can be wielded under intense stress would be ideal.

    Assistance greatly appreciated.

      Version 1 - When you know the accuser well, e.g. a family member:

      I will never know whether the alleged abuse happened or not, as only the two people involved know for sure. However, as I know both of the people very well, I have looked at their characters and thought carefully about the allegations, and on the whole I believe my partner/husband. However, I am keeping an open mind about this and if anybody can show me some evidence, or if the situation changes, I will reconsider my position. My number one priority is the children.


      Version 2 - When you don't know the accuser well:

            Essentially a civil trial to determine if events (usually allegations contained on a Scott Schedule) happened or not.

            Based on the findings, the court can then make directions.

            So in my case of alleged Child Sexual Assault, I need a FFH to prove I did or did not execute the alleged actions! For the avoidance of doubt I have never ever sexually abused anyone. However in this country you have to prove that (if you are a male).

              Interesting....I understand that custody hearings are usually put on hold until any concurrent sexual allegations have been disposed of but I wonder if the FFH comes first and finds that the allegations did not occur whether this would result in an automatic NFA?

                I have at least 3 matters in flight.

                So the CSA allegations. To contest the Non Mol raised, the only way is for a FFH to determine once & for all that events did / did not occur. Evidence indicating it did occur is weak (Only Mother's statement - otherwise I would be facing criminal trial). There is no medical or ABE evidence.

                Once the FFH determines what "did" occur or not, then Divorce FDR (Financial Dispute Resolution) & Children Act (Custody) matters can be determined (Having a CAFCAS Section 7 report on the meantime as well).

                I was just looking for tips on how to present. I am getting too little sight from Sol's & find myself having to learn on the job rather than prepare. I feel gravely about this behaviour. Not what I am used to at all.

                  I've worked on appeals where the family court transcripts have been used at the criminal trial - so yes family court hearings can and do go ahead regardless of the end result as that sometimes happen after.

                    I am under no illusion - this is a criminal trial in all but sentence. A significant difference, but still then same pernicious behaviours.

                    Having already had a criminal conviction handed down (harassment) I must say that the whole legal system is an absolute shower. Some would say I would say that wouldn't I.

                    However I relish the chance after 7 out of 10 months being under some form of Bail/Non Mol condition since allegation to face my FA & give then a run for their money (well actually my money as it is the wife).

                    What a sick character you must be to put a child through a Sexual Abuse Medical Exam when you know nothing has happened "just to remain in character as the victim".

                    I am going for coersive control & unfit mother s37 long term fostering / adoption IF I cannot get custody.

                    We will see if things appear credible.
