Falsely accused by a child-5year old

  • Falsely accused by a child-5year old

    A person whom I know very well is been convicted of falsely accused by 5year old girl. Jury made decision from the girls statement, nothing else against the person.IS there any way to get an appeal?
    do not know whom to approach as not sure if the people are genuine or fraud,

    Is he eligible for legal aid or would he have to pay privately?

    If privately please be careful as there are some sharks out there, who will charge a small fortune for doing not a lot.

      he was getting legal aid during his trial so now i dont know how the system works,will he still be able to get legal aid but the barrister said no grounds of appeal,they only considered 5 year olds statement as evidence.
      we are trying everything to prove his innocence but not able to find proper people or just literally dont know if there is any chance?

        You would need to contact another solicitor. First you need a written "Advice on Appeal" so ask your current solicitor for that.

        Then make a list of things that you think went wrong at the trial and see if that is enough for him to get legal aid.

          His solicitor advised no grounds of appeal as the cross examination could not take place properly due to restrictions on questioning child.But parents were giving contradictory statements which his barrister could not bring it up to the attention of jury.
          so just dont know if there is any chance for him ?which will be the best way and who is the best person
          it is over 28 days now and he was getting Legal aid till the trial.

            I didn't ask whether there are grounds for appeal I realise they say there are none otherwise you would not be here.

            I advised this:

            First you need a written "Advice on Appeal" so ask your current solicitor for that.

              Sorry about that...and thank you very much for the replys.
              We have already received the Advice on appeal from the barrister. Sought advice from another barrister from the same chambers but he also said there are no grounds to appeal. We have listed out all the discrepancies in the statements but do not know whom to approach. Contacted Stephen Cooper after searching on the internet but after seeing the opinion in the forum, decided not to get his help. Were quite unsure of the service and also about the huge fees. It is more than a month now, so we are desperate to find the right person to help us...
              Any recommendations of a barrister specialized in the matters will be most helpful...

                You will still need the written Advice on Appeal. It is a document that will be required by a new solicitor and/or barrister before they can proceed.

                He may be eligible for legal aid, depending on his circumstances. It is not at all necessary to spend thousands of pounds on an appeal (or trial) if the client is eligible for legal aid. There are some fabulous sols and barristers out there who work on legal aid, and paying a small fortune does NOT guarantee a win.

                  Oh my god don't even think about going there.I've got a friend who has a family member in a prison in the midlands. his family spent over a hundred thousand pounds on that outfit. Appeal didn't work. He has reported him and his solicitors and barrister to the releavnt authorities. He is in touch with anotehr family I believe who had the same happen to them

                  I met the person when I was visitng my son in the same prison and she told me about what happened to them. They've got somebody helping them now with an applicaiton to the ccrc

                  please be realy careful who you go to.

                      Try http://www.taylor-street.co.uk/nichola-coleman.html as she works on legal aid.

                      The trouble is, you will probably need to explain why you think the trial went wrong, rather than why the verdicts are wrong.

                      If you can provide some arguments as to what went wrong at trial or if you think the judge wrongly directed the jury (I appreciate you probably don't understand about directions but you might have heard something and thought "that's not right") you are more likely to get legal aid.

                              Thanks for the reply.
                              I just want to make clear that the allegation was relating him being an exhibitionist to the 5 year old child.Which i did not mention.Kindly advice us as you are being very helpful and we never came across this situation in our life,Just dont know whom to approach really.
                              Tried to contact Chris but unable to get through,is there particular time to call them or is there anyone else you would suggest for us.
                              I have checked the site you gave me and could not see any relevant to this particular matter.Are they solicitors or will they direct us to particular people for Advice for Appeal.
                              It is all new for us so just dont know how it works so please dont feel bad about my questions.
