      Corrupt police

      Today I received more documentation and im surprised how corrupt is the police.
      They have answers in my statement that I did not say (it was recorded by audio) and passed in to text now without being reviewed and signed by me.

      Besides this, the complainant changed the area where the alleged rape occurred so the room is not as it was when I left.

      And many many contradictions... "As a joke" one of the witnesses even say that they took a taxi and the taxi driver also participated in the alleged events...When we went back in the same car and the rest claims to have been driving all in the same car too.

        Hello mates

        Now I'm back here, it's been a long months of pain.
        Finally, in two weeks the trial begins.

        The situation now is good, there are many contradictions between the prosecution and I remain consistent with the truth.
        But there are also some issues with my statement, too extensive because i was a bag nerves.( never been in front a police man asking me with their style)

        There is also the possibility that she does´t come to trial because she lives outside Europe and is currently partying and with boyfriend ..

        I would like to know your opinion as I am going to the psychiatrist and barrister has asked me if I want the jury to know it and d´ont know if this can be good or bad. The report is positive and puts I'm taking medication and suffer anxiety and depression because of the false accusation. But barrister said they hypothetically may think that I am sorry for anything, this seems a bit crazy to me ... ( You know, you never knows..)

        It would also be helpful if you could give some recommendation to face trial. Dress, behavior of the CPS, key points for the jury

        I will also keep you informed.

          I would say don't use the report. Mental health is a still a taboo subject with most people who don't understand it. It may come down to who seems like the more reasonable person,a report like that may ruin that aspect.

          Dress smart,a suit or at the very least a shirt,trousers and smart shoes.

          Say nothing to anyone in the court waiting areas,keep your head down. Wait until you are in a private room with your barrister.

          The cps will say nothing now. Forget about them.

          During the trial just look straight ahead and look at no one or react to anything. Drastic reactions can make you look worried.

          If your defence has holes in,get ready to be attacked by the prosecution barrister. Have your answers ready as to why your stories are different.

          Be ready to go to prison straigh away if found guilty. Take a prison bag with stuff in on the last day of your trial.

                Trial canceled

                Hello again.

                The trial was canceled, I'm back.

                After a very stressful week preparing the case.
                On the first day, it came to light evidence that the complainant had received coaching in USA during two weeks for cross- examination with lawyers and therapists.

                This means abuse of process and is not permitted in Uk so the judge has requested an application.

                Does anyone know of a similar situation?

                I would also like to ask if the barrister may want to charge the trial days not concluded by the cancelacón trial.

                  Can't say i have,but then you dont hear about every single case in the courts.

                  In regards to fees,he will probably charge you for everyday that he expects to/actually does represent you in court. Probably a question to ask him or his clerks.

                      I recognise the case from the news,but didn't know about her trips to the US. Quite incredible how one man can be tied to one address for 20months,no real freedom and be aquitted in 30 minutes.

                          Thanks RF for reply.

                          The situation in my case it quite complicated.

                          The mother of the complainant sent an email to the Prosecutor explaining in every details (as trying to seem that all the work was done) how his daughter had been coached by lawyers and therapists to testify before the questions of my barrister.

                          This email was presented to the court as evidence.

                          However: My sol asked the CPS all the information and we demand the complainant to withdraw the right of confidentiality with US lawyers. CPS replied that the OIC is not available and ask for 3-4 weeks to deliver all which is impossible as the view of abuse of process falls for those dates.

                          So, at the moment we are trying to investigate that effectively she gone too far in US (there is allowed coaching) and the CPS does not want us to investigate trying to get us in trouble.

                          Every advice will be very appreciated.

                            Potentially what has been happening could be classed as "an Abuse of Process" - ie that if the CPS allow this then it could be said that they are abusing the criminal process.

                            You need to ask the solicitor or barrister about that as they would know more.
