Falsely accused - feeling alone. Please help????

    Help please someone help

    I haven't written on here for a while. We went reported for bail and all bail conditions got dropped for my husband, he came home, great we were and are all happy. We did get told though that CPS have requested further evidence from a third party which is my horrible step brother who hates me badly. Anyway we have been on holiday to have to come back a few days earlier, CPS feel there is enough and said it needs to go to trial. We got told this today, the OIC has changed and never met us before but seems pleasant, wanted to tell my husband the news before the letter came through and explain everything to him.

    I haven't taken it all in still feels not real, my husband says they have destroyed his life and told me he loves me and the two babies and if anything happens, or kills himself please look after the babies. I hate these people, why are the CPS so stupid not to see she has changed her story from actual to alleged. She has a bad reputation and we are a hard working family when all this family do is sit on their arse and claim benefits.

    Please help?
    What happens from the moment we receive the summons?
    What happens with social services from now on? What can I do to keep him home please?
    How do we get through this? I want to end my life it is so unfair
    Any recommendations for a solicitor in Devon I want the best

    How do we get through this I can't believe that CPS are taking this seriously when their reputation is bad. My own mother has said now she thinks irbid a vendetta now against me and her, as she went crazy in him with what is going on

        I am so so sorry hun we've also been a year and the CPS have asked for more information too but we've heard nothing. Big big hugs make sure he has a good solicitor I've heard it's easier once you the accused statements and can start ripping them apart. Keep strong babe you've survived a year you can keep going.

            So sorry to hear this update, I've just looked at the first posts in this thread to remind myself of your situation.

            I guess the CPS altered the charge to 'attempted' as they found no evidence to support 'actual' so you can take some comfort from that (and something his barrister should stress in cross-examination!) It's quite difficult to show that someone didn't 'attempt' to do something i.e. no evidence required, just opportunity but do remember that it is not the police or the CPS who will decide but the jury and from your previous posts you have plenty of motives for the malicious allegation being made to put to them.

            Variation of bail conditions will only occur at the preliminary Magistrates hearing and your solicitor will be able to make a good case for continuing as they are (as there have been no issues arising from him being at home with you)

                My thoughts go out to you I know exactly how you are feeling and it's the worst feeling ever. I've been at the lowest point of life thinking I can't go on but you need to dig deep and rise above these low life creatures. It's hard believe me I know but try and take each day as it comes.
                My son has also been FA by a so called family member, similar to you a vendetta and utter hatred.
                I've never truly hated anyone in my life but what I feel for this person goes further than hate.

                      Are you worrying about him being 'remanded in custody'? This is very unusual and is only ordered by the court if there is a risk of the defendant absconding or committing further offences, neither of which apply in his case as I mentioned in my earlier post.

                      The Magistrates hearing will fairly straightforward as they will simply rule that they do not have the power to try the case and will refer it to Crown Court (this will of course result in a further delay, however this gives him more time to prepare his defence!}

                        Instruct a solicitor (I've suggested two and there are lots of others in the solicitors thread under "Useful Information") and then ask the questions as they will know better than us. Each case is different.
