  • Falsely accused of child abuse

    I don't know where to start. My nephew has been accused of historical child abuse that 'allegedly' happened over 33 years ago by a female family member. She was 6 at the time and my nephew 16. She is adamant that her father caught him 'at it' but, this gentleman sadly passed away a few months ago.

    This man would have gone to the police if he'd caught him doing that - there's no doubt about it. He's no longer with us to say whether it happened or it didn't but, I'm pretty sure my nephew is innocent and the 'accuser' has waited for this 'witness' to pass away before she accused my nephew.

    Over the years, she accused two other male family members of pretty much the same but, the charges were dropped. However, with the Saville case in recent times, the police seem to be taking more notice of alleged child abuse. My nephew was arrested at his home he shares with his wife and 3 step children and taken off for questioning.

    The police collected his home pc, laptop, tablet and phone whilst he was being questioned. He was held at the station for 1 hour and released on bail and told he couldn't go back to his home until the social services had interviewed all three children. They are 14, 16 and 19 years old. My nephew has two children of his own to a previous relationship (these two children as of yet, haven't been interviewed).

    The social services visited the house the day after but my nephew still couldn't return until they have checked with the children's school records which will be sometime next week.

    The police returned all my nephew's gadgets the next day.

    It's turned my nephew's world upside down. He is a business owner, has always done well for himself etc etc but, the woman who accused him has had quite a rough life and we know she has major money worries. My nephew has a local criminal solicitor working with him but, would be prepared to pay for someone who is more experienced with historic abuse cases (he's even willing to sell his business if need be).

    My nephew is at breaking point. He's staying at a friend's house on the sofa so as not to break his bail conditions and is working all the time to try to take his mind off things. My nephew has never been in trouble with the police (he's 49 this year).

    The stuff the 'accuser' said he did was horrific and she said she suffered severe internal injuries (wouldn't that mean that it would have been reported to a hospital/gp?). We know this woman has had 4 children with no problems and has visited my nephew with her 4 children in tow on many occasions (she last visited 8 weeks ago and was 'normal' in her behaviour).

    Would you visit a man who'd 'abused' you as a child, putting your own children at risk? Nothing in these accusations adds up at all. My nephew is panicking after reading that many innocent men go to prison. I've advised him to stay away from the internet but, it's difficult I know. We're in North Yorkshire

    Hi and welcome to the forum,

    While it is impossible to say which way the case will go I think that most members who have been through the arrest process will agree that to only be detained at the police station for an hour and get the computers & phones back the next day is nothing short of miraculous!

    I suspect that the equipment wasn't actually examined which indicates the police are going through the motions as are social services (and of course these days the investigations have to seen to be thorough) none of this of course will help your nephew's feelings..... however from the forum you will see that he is not alone in his ordeal and it is not until someone has experienced this that it is realised how widespread the accusations are.

      Thankyou so much for replying. I have a feeling that the police know the history of the 'accuser' (as she has several visits to the police station for violence plus the additional false accusations in the past). My nephew's ex wife has also given a statement to the police about the 'accuser'. My nephew has so many questions and people seem to be unable to answer. He basically wanted to know when he will be allowed back in the family home. He just wants to be with his partner and step children. I've spoken to him this morning and he's really really down (not like him at all - he's always been such a positive person). I just don't know what to say or do to help him. Do you think getting a solicitor that is a specialist in historic cases is advisable? Also if so, would he have to wait to be 'charged' with the offence or can he swap lawyers now? (we know absolutely nothing about the law , we've never had any dealings with lawyers and police so it's really daunting and extremely frightening)

            A solicitor cannot claim legal aid on his behalf unless he is charged so will probably not wish to get too involved; however there is nothing to stop him consulting a solicitor on a private basis though as there will be no paperwork the solicitor will only be able to give him general advice regarding the accusation.

            If it should happen that he needs a solicitor then it would be well worth looking at this link with member's recommendations from personal experiences.
