    hi my son was convicted but he is innocent their was no Dna found on him or the other person or in the room he was trying to help his cousin by boosting his confidence x this is wat he got being falsley accused he has never been in trouble before this x basically it's his word against my sons the family has done this before x got big payout for ruining someone's life we really need help and we don't know where to turn I been to loads of solicitors they want a lot of money upfront which we don't have the barrister was a new one who just got this on the first day of trial x he had never dealt with a case like this before so my son got convicted which we believe he shouldn't have their was no evidence at all only his word how can they do this please help

    It is entirely possible that your sols entitled to legal aid so money may not be needed up front. The problem is, finding a good solicitor on legal aid who has a good reputation for working on such appeals against conviction.

    Did trial counsel write an Advice on Appeal? If he did not, your son is entitled to one on the trial legal aid.

    Do you know how long trial counsel had the paperwork? I ask, as you say he came in on the first day of trial.

      hi he only had an hour to read them before trial started the solicitor had all paperwork it took nearly 12 months to get to trial which he was on bail the barrister did put in an appeal x it wasn't good enough which I don't see how he couldn't off made it better and brought up things that were not mentioned in court and all they said was unfortunately his word against my sons which I think is really unfair as they have ruined his life , the probation bloke is very arrangant I rung him to speak about my son x he was like he is high risk x that my son needs to admit he's guilty x I said no way my son will not admit it because it's all lies and he is and will alwAys maintain his innocence but we need help x not sure where to turn any suggestions will be greatly appreciated .

        Human Rights Act

        Article 6:

        Section 3: Everyone charged with a criminal offence has the following minimum rights:

        (a).................................

        (b) to have adequate time and the facilities for the preparation of his defence;


        You need to find out from trial solicitors when the fresh barrister was sent "the brief".

          Hi susansue- sorry to hear of your son's plight- as you will see from this forum there are a lot of us in the same predicament.

          I can't help with anything legal, just to say we all understand what you're going through and can offer virtual hugs and support.
