  • Compensation?

    I am a support worker. About 5 months ago one of my service users ,an 18 year old with learning difficulties, went to the police and accused me of raping him. In the middle of the night I got arrested, questioned, phone seized and subsequently bailed, so after 4 months, I got nfa'd. So so happy. It's been a very stressful time for me and my family. I am still baffled who someone I looked after and gave independence to would do that.

    In this period of 4 months while the investigation took place, I couldn't work. Do I have a case to pursue compensation for loss of earnings? Financially this has put us back. If any one can recommend me a solicitor I'd be very grateful

    I don't think so. The police must investigate every allegation no matter how stupid it may appear to the accused and their loved ones.

    How did your works find out? Did the police tell them, or you?

    You might want to look for an employment solicitor who can advise you about loss of earnings.

      Yes understand that the police have to pursue the allegation. My service users mum was my employer but she had a budget through the council.

        Your accuser's mum was your boss? Hmmmmmm could she have encouraged him to make the allegation as she couldn't afford to keep you on?

          I don't think so, he needed 24 hour care. So would need a support worker. I go on with her, well I thought i did.

            There are other legal ways to get compinsation, if you Google commercial liens and tortes you could potentially get money from the accuser, but as the accuser has learning disabilities you may run into problems such as capacity. If I get a nfa I intend on serving a commercial lien again my accuser. The good thing about them is you require no courts and no solicitors, the emphysis is on them to prove that they didn't accuse you not the other way around.

              Maybe she has as a friend or family member who needed your job.....


              The good thing about them is you require no courts and no solicitors, the emphysis is on them to prove that they didn't accuse you not the other way around.

              It's not a question of whether they accused you, it's a question of whether the allegations were provably false. If you cannot prove it was false beyond every single smidgen of doubt, then you will pay their costs as well as your own, for court time, even if you do not use a solicitor.

              Unless you have money to risk losing (and it's a very high risk that you would) then it's not worth it.
