  • In desperate need of answers! Is my sister lying?

    My 16 year old sister has recently reported to the police and social workers that my step father had sexually abused and raped her. He has since been released from prison due to no evidence! She stated that there were text messages sent from him but again there was nothing to prove this with the phone analysis taken by the police. The medical doctors that specialise in rape and sexual abuse found no evidence of rape and concluded she was still a virgin. The case has been dropped because there was absolutely nothing to back up her claim!
    My mum and step father have been engaged for a while and unexpectedly share a newborn baby. My mother was unaware she was pregnant for a while due to the stress of police investigation and the medication she had been put on for a bad leg surgery.
    Since the case was dismissed my sister has been acting out! She sits in her room all day and refuses to speak or see old time family friends! She has physically and verbal attacked me simply because I said something she doesn't like! She has said to me and my mother on many occasions that we could die for all she cares.
    We have tried talking to her and we have also tried letting her be to not anger her but nothing works! She says she likes being left alone but then complains that we don't care about her! Police, doctors and her own teachers have stated that there was something not right about her story, a story which I know nothing about!
    I know my sister and she always expresses her opinions and feelings not caring how bad or brutally honest it was! Of she was to have been raped she's definitely not stupid she would have done anything to make sure those who need to know be aware! She talks to only one person who has been through the exact same situation funny enough however that person messaged me to ask whether my sister was doing okay because she refused to speak to this person.
    Sorry that's as brief as I could make it! I've honestly been so stressed about this and I am getting no answers from anyone so this is the only place I could think of!

    I really can't say and I don't think anybody on this forum would be able to answer that, though I could be wrong.
    It must be a really difficult situation to be in. In a situation like this the only people who KNOW the answer for sure would be your sister and stepdad.
    I have to say though that if she had been abused and raped then it's extremely unlikely that her maiden head would still be intact which I'm guessing is what the doctors who examined her found. This may not be what you want to hear, but it seems highly likely that she could be making this up unless there is something the people who examined her have missed.
    Strange that she stopped talking to the person who messaged you to ask how she was.

      Maybe she is feeling a little stupid now that she knows she is not believed.

      You say the accused was released from prison​. What was he doing there? Was he remanded into custody during the investigation? If so, do you know why?

        He was taken to prison due to the allegations made by her. After there was no evidence found the police kept him there for some passport issues as he is a citizen of Spain and West Africa. The case was dropped entirely due to no evidence and my sister dropped the case

          A person cannot be remanded into prison just because somebody has made an allegation against them.

          It's likely that in this case, they felt he could be a flight risk. Do you know what the "passport issues" are?

          Other reasons for remanding into custody can include potential for interfering with witnesses with the intention to pervert the course of justice.

            He was there for 3/4 months however I am unaware of any other reason he was jailed. He has never committed any crime so therefore doesn't have any criminal record. There was also no major issue with his passport. We were only told he was in custody due to the allegation and remained there for passport issues. Although I don't know the exact problem other than it was a Spanish passport. The police officer taking the case travelled all the way to Spain to get his passport. This police officer is now being investigated for not carrying out the case fairly. A local solicitor/mp stated that he was treated unfairly throughout the entire case.

              If everybody who had an allegation made against them were remanded into custody the prisons would be in a worse state than they are already are in. There has to be good reason.

              I rarely travel abroad so don't know the rules as such. I recently went to Germany and I used my passport, however many were travelling using an EU identity card. Is that how he traveled here? I ask as I am wondering if there is a genuine case to claim for false imprisonment.

                I honestly don't know. No one knows but the police officers and the solicitors really. I wish I knew to tell you if there was any other reason he was imprisoned but there's honestly nothing else. He was released on bail then the case was dropped swiftly after. We live in Northern Ireland if there is any difference? I was unaware he was imprisoned for at least a month. He himself is unaware of most of the situation as well as myself and my mother. The only information we get is from our solicitor and very little from the social workers

                  If someone who has been interviewed and bailed for a criminal investigation to take place has connections overseas the police will seize their passport until the investigation is concluded.

                  In this case, as RF surmised, he was obviously considered to be at risk of absconding and was held in custody until the passport was available (and presumably this is still being held by the police even though he has been released from police custody)

                  In fairness to the police, when these allegations are first made they have to assume they are genuine; it is not until the investigation is under way that the doubts come out.
