  • false rape allegation at work

    I was falsely acuesd of Rape last year,by a girl that had come to visit a client I was looking after
    the ,the client asked me to talk the the girl because he thought she had stolen his phone,whilst in the room talking to her she started fondling my private parts
    I told her to stop
    Only to have the police knock on my door the next day
    saying I am being arrested in suspicion of rape
    I was held at the police station
    untill a duty solicitor
    showed up
    they took my Dna
    then after being advised to reply no comments
    to all the questions
    i was released on police bail with the only condition being that I should reside at my home address and not contact the accuser, I then received a text from the police telling me that my bail had been extended by about 8 weeks
    I received a letter from the DBS
    saying that they had a referal from the local police
    in connection with my arrest
    but there are no restrictions to my work yet
    I would like to know if this referal means that they are more than likely going to charge me when I answer bail

      Hi and welcome to the forum,

      I'm sure Rights Fighter will respond when she is able but currently she is snowed under with legal work (as can be imagined from the number of fase allegations being made!)

      However from what you have written:

      There should be none of of your DNA in or near her vagina (unless she put it there herself!!) She must have reported the rape allegation almost immediately and therefore should have been swabbed for DNA and this hopefully will clear you; as you probably know a rape charge involves actual or attempted penetration.

      I realise there are a lot of 'coulds' and 'shoulds' in this advice but I'm afraid this is the name of the game

        Just about to send Sparks's appeal off then will have a little time to help out more on here.

        Referral on DBS suggests that you work with vulnerable people. The police have to investigate (or "investigate") every allegation.

        Look at it another way, if the police are investigating a person who has really sexually offended, and they allow him to continue to work with vulnerable people, and something happens, imagine the outcry and the headlines.

        The police don't know you are innocent. Whatever their procedures and protocols in their area are, they should abide by them.

        If informing DBS of the allegations is a procedure within your local police force, then that is what they will do. All you can do is to hold on in there and wait. Sorry I cannot be of more assistance at the moment.

          may I ask? How she would be able to put rights fighter Thank you for your time
          I was just wondering if there was a way that I could find out if this standard procedure in my county (refering to the DBS)
          I also wonder if it is standard for the DBS
          to say I can continue to work (which they did)
          I am not sure if she got
          swabbed because I was told one of the managers
          at work that she was claiming not to remember
          as she was drunk
          she had come to visit, the two clients who I was looking after
          one who was on tag (police )
          The other a sex offender
          and she had aparently she had just become his girlfriend
          and he saw us leave the room
          and was angry with her
          and that's how the rape allegation came about

            Worrying about DBS when they are allowing you to continue to work is not going to help you. At least you are still working.

            Whether she was drunk or not, they would or should have swabbed the complainant. I am sure they would have done.

            As I said before, all you can do is to sit back and wait. It is the same for all people in this situation.

                    I do hope all is well? Im finding it hard to breathe
                    because alot things are going well for me in life but I can't be happy with this hanging over my head
                    it was definitely some kind of setup
                    because when I went to bed they asked me for a pen and sat there with a piece of paper
                    which turned out to be statement
                    the funny thing is the police have never returned to interview the two boys since the day of the incident
