  • Can I Get the Cctv - On Pre Charge Bail

    Hi all,

    Im hoping somebody knows, can i search for cctv footqge while on im pre charge bail?

    I had consentual sex with a girl on a one night stand but cant remember a lot of it.

    The police are investigating and it's killing me not know what they will see on cctv. My solicitors says not to contact the club or hotel... But coukd i contact the establishments opposite the club to see if im there and to ease my mind that she was all over me?

    Even if she was all over you, it could be later on that she says the alleged rape occurred. So being all over you beforehand doesn't really take the case anywhere - unless she says that she was unwilling from meeting to after the alleged assault

      I would also be interested in any advice about this. My son has recently been arrested on a 'suspicion of allegation of rape' charge. He did not accept the offer of a solicitor as he believed he had done nothing wrong. Both were drunk but my son did at least ask her if she had a condom. I would have thought that at this point she could have told him she wasn't interested. Anyway he says he walked away and she followed him. CCTV footage would show this.

        Hi - I don't know the answer re defendant's collecting CCTV footage - but I just want to share some information. A friend's son was caught up in some trouble late in town and was arrested. When interviewed the police showed him some CCTV footage which made him confident they had no evidence and he refused to admit to something he hadn't done. The CCTV showed his friends committing a crime, but not him. His friends pleaded guilty.

        The point of my post - when the lads were in court for sentencing my friend attended as a character witness. It was clearly evident that the CCTV footage shown to the judge had been edited to make the incident look worse for the lads being sentenced. The footage shown in court no longer showed that the accused lads had not started the fight, or more importantly that one of the accused initially got involved to intervene and restrain his friend, however had then been attacked himself and retaliated.

        After our experience with the police my confidence and trust has been severely dented, but I didn't think they could get away with tampering with evidence! I think if there is a way to access CCTV footage from independent cameras rather than from what the police decide to disclose to the defense team it should be pursued - before something critical is taped over. That's the route my friend took, but the CPS didn't pursue a prosecution for their son so it wasn't relevant in the end, the lads all had different solicitors so the police CCTV evidence issue was not raised in court.

          What about the hotel cctv? Her statement doesnt make mention the hotel lobby, clearly we are there together whilst im paying for the room, doesnt this mean that she knew that sex was on the cards and as long as she walks in without assistance, it was consentual?

            Unless there was CCTV in the room then nothing can prove that sex was consensual and of course there is no CCTV in the room. Her version of events might be that she might have thought she was going to your room for a drink or talk, nothing else.

              You have to be in the mindset of how the police/CPS will view your evidence/suggestions.

              She may well have willingly gone into the room with you, knowing full well that she had previously agreed to sex, but what she tells the court may well be something different. And of course, she could have initially agreed to sex beforehand, then once inside the room, genuinely decided against having sex with a stranger.

              It's the "locked door" syndrome - only you and she really know what went on. It is up to the jury who they believe.
