  • Help Please!!!

    I have tonight been informed by my Granddaughter that her boyfriend has today been found guilty of a rape he did not commit.
    Apparently this process has been going on for a year but they kept it all secret because he was so ashamed and they were confident that he would be acquitted.
    I have few details and I am still trying to get my head round all this. He has only had legal aid solicitors and barrister and it sounds as if he has been poorly represented. If only they had confided in me earlier I may have been able to help.
    I have only known the boy for a year but have full confidence that he is telling the truth. He is in prison tonight and will be sentenced next week.
    What on earth can I do to try and get this overturned?. What are the rules re appeal? Where do I go, what should I do?
    Please Help.

      So sorry to hear this Gramps. Welcome to the forum anyway. It's such a shame when something as serious as this happens that many young people don't realise it's too big to handle on their own and perhaps forgo advice and the support they need.

      I'm sorry the legal team he had were not up to scratch - my son had a solicitor and barrister who work on legal aid cases, both were excellent. Some people pay huge sums and are badly let down, it's always best to double check the credentials of lawyers and make sure they have known experience and success in a particular domain.
      There are lawyers specialise in appeals to do with sex-crimes.

      As far as I know, for an appeal to be considered there has to be new evidence which wasn't available at the time of the trial. It's not an automatic right, and is a lengthy process. Don't be put off though. I'm sure RF will give you some excellent advice.

          think of us one big family if you will i am to currently going through hell at the moment but i am awaiting my first admin hearing in crown court for them to decide the actual trial date if it gets that far but my sols are working on persuading the devil prosecutors to drop it but i will have to wait to see what comes of that anyway keep posting and then once you get to 10 posts and have been on here more than a week you will be made a full member so stick it out

              if you are on Facebook or if your granddaughter is, get her to apply to join the PAFAA with SOFAP Facebook group. I always ask people why they want to join before they are allowed into the FB group, so you/she can then explain the problem to me.

              You need help asap, as the first hurdle is to get 'leave to appeal out of time' once Grounds are established.

                        Hi Gramps and welcome to the forum though so sorry that you have had to find us and what your granddaughter has gone through with her boyfriend. As you are already in contact I cannot add to the excellent legal and practical advice you will get from her....
                        On the emotional side though, you and your granddaughter and any other members of your family might consider getting help and support from your GP's or consider alternative remedies such as Bach's recue remedy or 5-HTP - though always check with your GP that it is ok for you to take them.....look forward to meeting you and your granddaughter on FB .....keep strong MH
